According to prosecutors, Brittany Gosney and her boyfriend "hog-tied" and gagged her three children in the time leading up to the death of her 6-year-old son James Hutchinson.
A filing in the Butler County Court of Common Pleas this week states each of the children were bound with their "hands and feet behind (their) back."
A "cloth material" was placed in their mouths "to terrorize and/or inflict serious physical harm," the documents state.
Prosecutors said the children were left in this position "for several hours."
The documents also state that after James was killed his body was left in the couple's Middletown residence for "almost 48 hours" before they dumped him in the Ohio River in the middle of the night over the weekend of Feb. 27.
Search teams are still trying to locate his body when the weather and river conditions allow it. On Wednesday morning, the search had been suspended again due to bad conditions, but officials said it would resume as soon as it was possible.
Gosney and Hamilton are charged with a total 31 felonies. Both face multiple counts of gross abuse of a corpse, child endangering, kidnapping, abduction and tampering with evidence.
Gosney is also charged with murder and involuntary manslaughter.
The court has ordered her competency and sanity at the time of the offense to be evaluated after her attorney began the filings necessary for Gosney to plead not guilty by reason of insanity.
"(Gosney) struggles to assist in her defense and counsel has serious concerns regarding defendant's mental health," her lawyer wrote in court documents.
A competency evaluation hearing is scheduled for April 26 in Gosney's case. She is being held on a $2 million bond awaiting trial.
Hamilton's next court appearance is scheduled for April 12. His bond was set at $750,000.
