A murder trial for Brittany Gosney, the woman accused of killing her 6-year-old son while attempting to abandon her children, has been scheduled for September.
Butler County Common Pleas Judge Noah Powers set Sept. 20 as the date for the trial to begin.
It was initially scheduled to start Monday, but that date was vacated. It is not uncommon for attorneys to take many months to prepare for a murder trial and the date could be moved again.
At least one more hearing in the case is scheduled before September.
Gosney, 29, is accused of hog-tying her three children and attempting to abandon them Feb. 26 in a Preble County park where they had taken family trips in the past.
Police said that James grabbed the door handle of the van as Gosney tried to speed away. He fell, suffered a head trauma and died, officials reported.
Gosney and her boyfriend, James Hamilton, confessed that they later dumped the boy's body in the Ohio River near Lawrenceburg, Indiana, according to court documents. The child’s body has still not been recovered.
Gosney and Hamilton face a combined 31 felonies including gross abuse of a corpse, endangering children and tampering with evidence. Gosney is charged with murder, Hamilton is not.
The couple will face separate trials.
Court documents show Gosney tried to relinquish custody of her children prior to the incident. Officials said her surviving children have been placed in foster care.
Gosney initially pleaded not guilty by reason of insanity, but Judge Powers ruled that she was competent to stand trial after she was given a psychological evaluation.
Gosney and Hamilton remain in the Butler County Jail awaiting their trials.
