Supreme Court Justice Stephen Breyer will retire at the end of this session, according to sources. The 83-year-old has been a consistent liberal vote on the court. Now, President Joe Biden will have a chance to nominate his first Supreme Court Justice pick of his presidency.McGeorge School of Law Professor Leslie Jacobs joined Sacramento sister station KCRA to discuss one of Biden's top candidates from California – Justice Leondra Kruger. Biden is eyeing at least three judges for the expected vacancy, and each of them would fulfill his campaign pledge to nominate the first Black woman to the nation’s highest court, according to aides and allies.Kruger is currently a justice on the California Supreme Court. She is a graduate of Harvard and Yale’s law school and was previously a Supreme Court clerk. Kruger has argued a dozen cases before the justices as a lawyer for the federal government."She brings excellent qualifications; she has an excellent law school education; she has private law firm experience, government experience and now she has experience being a judge on the California Supreme Court," Jacobs said on Wednesday. "She has shown herself to be reasoned and deliberate in her opinions. Not wild or ideological." Jacobs said Kruger is comparable to Breyer because her rulings are practical."One thing is the stakes are not as high as they have been because the lineup on the court is set. So, that is not on the table. At the same time, we can expect there will be posturing and opposition, but the question would be 'Will there be such opposition that Republicans, for example, would try to stop this?' But they actually do not have the power to do so unless some Democratic senators were to defect," Jacobs said. California Gov. Gavin Newsom remarked on Breyer stepping down Wednesday. The San Francisco native "has brought core California values to our nation’s highest court throughout his distinguished tenure, shaping impactful decisions to strengthen our democracy and change lives for the better," Newsom said. Justice Breyer will retire at the end of the summer, according to two sources who confirmed the news to The Associated Press on Wednesday. The Senate can confirm a successor before there is a formal vacancy, so the White House was getting to work and it was expected to take at least a few weeks before a nomination was formalized.Other successors Biden is considering include U.S. Circuit Judge Ketanji Brown Jackson, and U.S. District Judge J. Michelle Childs. The Associated Press contributed to this report.

<p>The New York attorney general is trying to break up the National Rifle Association over allegations of mismanagement and the abuse of member money.</p>
<p>Adam Winkler, a UCLA law professor who specializes in the Second Amendment, says this is just the start. The legal battle could go for another year or two.</p>
<p>If the NRA dissolves at that point, it would have a huge impact on American politics, but that doesn't mean the end of the gun debate.</p>
<p>“What happens is the resources of the NRA would be distributed in a way that is designed to match the donors' intent,” said Winkler. “And that means that money would go to gun rights organizations and would go towards fighting against gun control in most, most circumstances.”</p>
<p>Winkler says the NRA dissolving isn't the only potential outcome. The attorney general is also seeking less drastic repercussions, like removing certain in-house lawyers or board members. That includes Wayne LaPierre, the executive vice president.</p>
<p>We don't yet know exactly what evidence there is. Winkler says the AG’s case has at least one advantage, the NRA’s former public relations firm, Ackerman McQueen, is cooperating.</p>
<p>“And so, the attorney general is going to have on her side an insider who's seen everything that's happened in the NRA for the last three decades,” said Winkler. “I think the NRA is in big trouble.”</p>
<p>He says the lawsuit could also impact the November election by energizing pro-gun voters looking to support the NRA and the Republicans.</p>
<p>Winkler says it's also likely to mean less NRA spending compared to 2016.</p>

<p>Predicting the outcome of elections can sometimes be easy. Other years, it is not. Professor Allan Lichtman has predicted every election since 1984, using a model he developed alongside Soviet Union scientists.</p>
<p>One of Lichtman's proudest achievements was accurately predicting the 2016 election. President Donald Trump signed a Washington Post article about Lichtman in recent years with his autograph and the phrase "good call."</p>
<p><b>THE METHOD</b></p>
<p>Lichtman doesn't look at polls.</p>
<p>"Polls are not predictors, they are misused as predictors," Lichtman said.</p>
<p>Instead, Lichtman looks at the political party currently controlling the White House. Then he uses 13 keys to gauge whether the party controlling the White House will lose or not.</p>
<p>They are: midterm gains, no contest in the primary, incumbency, no third party, strong short-term economy, strong long-term economy, major policy change, no social unrest, no scandal, no overseas failure, major overseas achievement, charismatic incumbent, uncharismatic opponent.</p>
<p>"If six or more, any six more, turn against the party holding the White House, they are a predicted loser," Luchtman said.</p>
<p><b>2020 PREDICTION</b></p>
<p>Lichtman says before 2020, Trump appeared to be heading to a reelection. However Trump has now lost seven keys.</p>
<p>In Lichtman's opinion, Trump has lost midterm gains, short term economy, long-term economy, no social unrest, no scandal, major overseas achievement, and charismatic incumbent.</p>
<p>"Could I be wrong? Of course human beings are wrong. But my keys have quite a track record," Lichtman said.</p>
