ATLANTA (AP) — A judge in Georgia has found that U.S. Rep. Marjorie Taylor Greene can run for reelection.

State Administrative Law Judge Charles Beaudrot concluded that a group of voters who had challenged her eligibility failed to prove she engaged in insurrection after taking office.

The decision to allow Greene on the ballot will ultimately be up to the secretary of state.

State law says Beaudrot must submit his findings to Republican Secretary of State Brad Raffensperger, who has to decide whether Greene should be removed from the ballot.

Once he makes his final decision, both sides will have an opportunity to appeal the ruling.

The House committee investigating the attacks on the U.S. Capitol on Jan. 6, 2021, will reportedly hold two more hearings next week.

The first hearing is scheduled for Tuesday. It will begin at 10 a.m. Eastern. The second hearing will be held on Thursday in primetime, according to NPR and NBC News.

It will be the second time the committee has held a hearing in primetime. The first hearing, which took place on June 9, was also televised in primetime.

The committee has attempted to show how former President Donald Trump attempted to overturn the results of the 2020 election and fueled conspiracy theories, leading to the riots.

In some of the most damning testimony, former White House aide Cassidy Hutchinson said Trump wanted to go to the Capitol on Jan. 6 to be with his supporters.

Hutchinson said White House lawyer Pat Cipollone warned that they could be charged if Trump goes to the Capitol. Trump ultimately went back to the West Wing.

After public calls to testify, Cipollone is expected to go before the committee in private on Friday.

A judge ruled on Tuesday that Couy Griffin is disqualified and barred from elected office due to his participation in the Jan. 6 riots at the U.S. Capitol.

Griffin, founder of "Cowboys for Trump," was convicted in March of breaching the U.S. Capitol. At the time, he was serving as a county commissioner in New Mexico.

State District Court Judge Francis Mathew said in his ruling that Griffin violated his oath to uphold the Constitution when he engaged in the insurrection.

The ruling was the result of a civil lawsuit brought by three plaintiffs who argued that Griffin should be barred from holding public office because of a clause in the 14th Amendment. According to The Associated Press, the clause says people who engage in an insurrection can be barred from office.

NPR reports that this is the first time someone has been removed from office since the Civil War under that provision.

Griffin was reportedly shocked by the judge's ruling.

"I really did not feel like the state was going to move on me in such a way," he told CNN. "I don't know where I go from here."

NEW YORK (AP) — Allen Weisselberg, a longtime executive for Donald Trump’s business empire whose testimony helped convict the former president’s company of tax fraud, was sentenced Tuesday to five months in jail for dodging taxes on $1.7 million in job perks.

Weisselberg, 75, was promised that sentence in August when he agreed to plead guilty to 15 tax crimes and to testify against the Trump Organization, where he’s worked since the mid-1980s and until his arrest, had served as chief financial officer.

He was handcuffed and taken into custody moments after the sentence was announced and was expected to be taken to New York City’s notorious Rikers Island jail complex. Weisselberg will be eligible for release after a little more than three months if he behaves behind bars.

As part of the plea agreement, Judge Juan Manuel Merchan also ordered Weisselberg to pay nearly $2 million in taxes, penalties and interest — which he has paid as of Jan. 3. Additionally, the judge ordered Weisselberg to complete five years of probation after his jail term is finished.

Weisselberg faced the prospect of up to 15 years in prison — the maximum punishment for the top grand larceny charge — if he were to have reneged on the deal or if he didn’t testify truthfully at the Trump Organization’s trial. He is the only person charged in the Manhattan district attorney’s three-year investigation of Trump and his business practices.

Weisselberg testified for three days, offering a glimpse into the inner workings of Trump’s real estate empire. Weisselberg has worked for Trump’s family for nearly 50 years, starting as an accountant for his developer father, Fred Trump, in 1973 before joining Donald Trump in 1986 and helping expand the family company's focus beyond New York City into a global golf and hotel brand.

Weisselberg told jurors he betrayed the Trump family’s trust by conspiring with a subordinate to hide more than a decade’s worth of extras from his income, including a free Manhattan apartment, luxury cars and his grandchildren’s private school tuition. He said they fudged payroll records and issued falsified W-2 forms.

A Manhattan jury convicted the Trump Organization in December, finding that Weisselberg had been a “high managerial” agent entrusted to act on behalf of the company and its various entities. Weisselberg’s arrangement reduced his own personal income taxes but also saved the company money because it didn’t have to pay him more to cover the cost of the perks.

Prosecutors said other Trump Organization executives also accepted off-the-books compensation. Weisselberg alone was accused of defrauding the federal government, state and city out of more than $900,000 in unpaid taxes and undeserved tax refunds.

The Trump Organization is scheduled to be sentenced on Friday and faces a fine of up to $1.6 million.

Weisselberg testified that neither Trump nor his family knew about the scheme as it was happening, choking up as he told jurors: “It was my own personal greed that led to this.” But prosecutors, in their closing argument, said Trump “knew exactly what was going on” and that evidence, such as a lease he signed for Weisselberg’s apartment, made clear “Mr. Trump is explicitly sanctioning tax fraud.”

A Trump Organization lawyer, Michael van der Veen, has said Weisselberg concocted the scheme without Trump or the Trump family’s knowledge.

Weisselberg said the Trumps remained loyal to him even as the company scrambled to end some of its dubious pay practices following Trump’s 2016 election. He said Trump’s eldest sons, entrusted to run the company while Trump was president, gave him a $200,000 raise after an internal audit found he had been reducing his salary and bonuses by the cost of the perks.

Though he is now on a leave of absence, the company continues to pay Weisselberg $640,000 in salary and $500,000 in holiday bonuses. It punished him only nominally after his arrest in July 2021, reassigning him to senior adviser and moving his office.

He even celebrated his 75th birthday at Trump Tower with cake and colleagues in August, just hours after finalizing the plea agreement that ushered his transformation from loyal executive to prosecution witness.

Rikers Island, a compound of 10 jails on a spit of land in the East River, just off the main runway at LaGuardia Airport in Queens, has been plagued in recent years by violence, inmate deaths and staggering staffing shortages.

Though just 5 miles (8 kilometers) from Trump Tower, it’s a veritable world away from the life of luxury Weisselberg schemed to build — a far cry from the gilded Fifth Avenue offices where he hatched his plot and the Hudson River-view apartment he reaped as a reward.

The House Committee investigating the attacks on the U.S. Capitol is in talks with former Vice President Mike Pence's counsel, according to Rep. Liz Cheney.

The congresswoman told ABC News that she hopes Pence will testify.

"He played a critical role on January 6. If he had succumbed to the pressure that Donald Trump was putting on him, we would have had a much worst constitutional crisis," Cheney told ABC News correspondent Jon Karl.

Pence said earlier this week that he would consider testifying before the committee. However, he noted that it would be unusual for a vice president to testify in this type of investigation.

"Under the Constitution, we have three coequal branches of government," Pence said. "Any invitation directed at me, I’d have to reflect on the unique role I was serving in as vice president. It would be unprecedented in history for a vice president to be summoned to testify on Capitol Hill."

Former President Donald Trump has railed against the committee, claiming the investigation is a "witch hunt."

Public testimony has shown Trump launched an intense pressure campaign to try to get the results of the 2020 presidential election overturned. When those efforts failed, hundreds of his supporters stormed the Capitol.

Once the Capitol was eventually cleared of the rioters, Congress returned to certify the Electoral College results and declare Joe Biden the winner.

The district attorney investigating former President Donald Trump's conduct after the 2020 presidential election has requested security assistance from the FBI.

On Sunday, Fulton County District Attorney Fani Willis sent a letter to J.C. Hacker, the head of the bureau's Atlanta field office.

"I am asking that you immediately conduct a risk assessment of the Fulton County Courthouse and Government Center, and that you provide protective resources to include intelligence and federal agents," the letter states.

Willis noted Trump's rhetoric at a rally in Texas over the weekend. She said the president called the prosecutors investigating him "vicious," "racist" and "radical." Willis said he also encouraged his followers to protest if the prosecutors do anything "wrong or illegal."

Last week, a judge signed off on an order to allow Willis to impanel a special grand jury in the investigation.

In the letter to the FBI, Willis said the grand jury will convene on May 2.

The congressional committee investigating the Jan. 6 attacks on the U.S. Capitol has asked for House Minority Leader Kevin McCarthy's voluntary cooperation.

In a letter to McCarthy, committee chairman Bennie G. Thompson notes the Republican's public statements about speaking with former President Donald Trump on Jan. 6.

He told Norah O'Donnell of CBS News that he was "very clear with the president" when he called him.

"This has to stop and he has to go to the American public and tell them to stop this," McCarthy said.

Thompson claims McCarthy can provide the committee with information about Trump’s state of mind during the attack.

The committee also wants to question McCarthy about conversations he had with Trump and White House staff days after the attack.

Thompson said the committee would like to meet with McCarthy in early February but added that it would accommodate his schedule.

Late Wednesday, McCarthy issued a statement that says the "investigation is not legitimate."

He went on to say he will not participate in the investigation.

Former Vice President Mike Pence will likely be asked to voluntarily appear before the congressional committee investigating
the Jan. 6 attack on the U.S. Capitol.

in an interview with NPR, Rep. Bennie Thompson, chair of the committee, said he expects the committee to make the request before the month is over.

Pence was overseeing the Electoral College vote count when rioters stormed the Capitol.

Upset with Pence for refusing to help overturn Joe Biden's win over then-President Donald Trump, some protesters chanted, "Hang Mike Pence."

Pence was ushered to safety while rioters overtook the Capitol.

Thompson noted that Pence was in a "tough spot" on Jan. 6 after facing a public pressure campaign to stop certification of the 2020 presidential election.

"So, if for no other reason, our committee really needs to hear what are his opinions about what happened on Jan. 6," Thompson said.

The committee is scheduled to meet next week about how to seek Pence's cooperation, NPR reported.

President Joe Biden told reporters Friday that he is suffering from a cold.

Biden, 79, was asked about his health after sounding hoarse while giving a speech about the November jobs numbers.

He said he doesn't have COVID-19, adding that he is routinely tested for the virus.

"What I have is a 1 1/2-year-old grandson who had a cold, who likes to kiss his pap," Biden said.

Biden underwent a routine physical in November.

His primary care physician attributed Biden's increased throat clearing to gastrointestinal reflux.

During the visit, Biden also had a colonoscopy and had a polyp removed.

Dr. Kevin C. O’Connor said it was benign but could potentially be pre-cancerous. He said Biden should have another colonoscopy in seven to 10 years.

More subpoenas in the Jan. 6 congressional investigation were issued Tuesday.

Subpoenas were issued for Proud Boys International, L.L.C., Oath Keepers, Henry "Enrique" Tarrio, Elmer Stewart Rhodes and Robert Patrick Lewis.

"Members of Proud Boys International, L.L.C., called for violence leading up to January 6th, and at least 34 individuals affiliated with the Proud Boys have been indicted by the Department of Justice in relation to the January 6th attack on the Capitol," the select committee investigating the Jan. 6 attack on the U.S. Capitol said in a statement.

The committee alleges the Oath Keepers were also involved in planning and participating in the attack.

Tarrio and Rhodes both had leadership roles with the Proud Boys and Oath Keepers, according to the committee.

Robert Patrick Lewis is reportedly the chairman of the 1st Amendment Praetorian, which the committee says provided security for rallies that led up to the Jan. 6 insurrection.

“The Select Committee is seeking information from individuals and organizations reportedly involved with planning the attack, with the violent mob that stormed the Capitol on January 6th, or with efforts to overturn the results of the election," Chairman Bennie G. Thompson. "We believe the individuals and organizations we subpoenaed today have relevant information about how violence erupted at the Capitol and the preparation leading up to this violent attack."

NEW YORK (AP) — Two Fox News Channel contributors have quit, saying “irresponsible” voices have drowned out the responsible on the network.

Jonah Goldberg and Stephen Hayes, who put out a newsletter called The Dispatch, have both been occasional analysts at Fox since 2009.

They cited Tucker Carlson's “Patriot Purge” documentary on the Jan. 6, 2021 riot at the U.S. Capitol as the last straw for them.

They said some of Fox's opinion hosts have “amplified the false claims and bizarre narratives” of former President Donald Trump and offered some of their own.

Fox did not have any comment on their claims.

Carlson told The New York Times that their departure was great news.

Steve Bannon was indicted on two charges Friday stemming from his refusal to comply with the congressional committee investigating the Jan. 6 attack on the U.S. Capitol.

"Bannon, 67, is charged with one contempt count involving his refusal to appear for a deposition and another involving his refusal to produce documents, despite a subpoena from the House Select Committee to Investigate the January 6 Attack on the U.S. Capitol," the Department of Justice said in a statement.

Bannon is expected to turn himself in on Monday.

The House voted in October to hold Bannon in contempt of Congress. The charge was then sent to Attorney General Merrick Garland to determine whether to pursue criminal prosecution.

“Since my first day in office, I have promised Justice Department employees that together we would show the American people by word and deed that the department adheres to the rule of law, follows the facts and the law and pursues equal justice under the law,” said Attorney General Merrick B. Garland. “Today’s charges reflect the department’s steadfast commitment to these principles.”

The Department of Justice says each charge carries a maximum of one year in jail.

An arraignment date has not been set.

Scott Fairlamb is the first person to be sentenced for assaulting a police officer during the Jan. 6 riot at the U.S. Capitol.

Fairlamb was sentenced to 41 months in prison on Wednesday, according to CNN. Prosecutors had asked for a 44-month sentence.

The former MMA fighter pleaded guilty in May to two charges, including obstruction of an official proceeding and assaulting, resisting, or impeding certain officers.

"I truly regret my actions that day. I have nothing but remorse," a tearful Fairlamb said in court, according to CNN.

Fairlamb's attorney said his client no longer holds the beliefs that led to participate in the rioting and would be willing to be interviewed by the congressional committee investigating the Jan. 6 attack, CBS News report.

It's unclear whether the committee will seek his testimony.

Fairlamb's sentence is the longest of any Capitol rioter, so far. It's believed the 41 months will be a benchmark for others facing similar charges.

A Capitol Police officer who was indicted for obstructing the Jan. 6 investigation has resigned, according to NBC News.

Michael Riley is accused of telling someone on Facebook to remove posts that showed them inside the Capitol during the Jan. 6 attack.

"The evidence will show that it is not a felony for one person to suggest to another that they take down ill-conceived Facebook posts," an attorney for Riley said in a statement, according to The Hill.

Riley was not in the Capitol at the time of the attack. He had responded to a report of a pipe bomb. He has been a Capitol Police officer for about 25 years.

Prior to his resignation, Riley was on administrative leave.

The committee investigating the Jan. 6 attack on the U.S. Capitol voted 9-0 to adopt a contempt report against Steve Bannon.

It’s the first process in holding Bannon in contempt of Congress for defying a congressional subpoena.

“The select committee will not tolerate defiance of our subpoenas, so we must move forward with proceedings to refer Mr. Bannon for criminal contempt,” said Chairman Bennie Thompson.

During Tuesday night’s hearing Rep. Liz Cheney directly called out Bannon and former President Donald Trump for their role in fueling the lie that the presidential election was stolen.

She also called on her fellow Republicans to refute the lie.

"You know that there is no evidence of widespread election fraud sufficient to overturn the election,” she said. “You know that the Dominion voting machines were not corrupted by a foreign power. You know those claims are false."

The House will still have to vote on whether to hold Bannon in contempt of Congress. Upon its adoption, House Speaker Nancy Pelosi would certify the report for the United States Attorney for the District of Columbia, who could formally bring the charge.

The Marine Corps is refuting implications that Lance Cpl. Hunter Clark was the person who lifted a baby to safety at the Kabul airport.

Clark told an audience at a rally for former President Donald Trump that he is “the guy that pulled the baby over the wall.”

Trump also claimed Clark helped evacuate children over the airport wall.

In a statement, obtained by CNN, the Marine Corps said Clark is not the person in the image.

"Regarding the viral photo that began circulating around August 20, 2021, the Marine identified in that particular image was not LCpl Clark," Kelton Cochran, a spokesman for the 24th Marine Expeditionary Unit said in a statement.

Clark’s mother attempted to explain the situation. She told CNN that her son “helped the baby once it was lifted over the wall.”

The statement from the Marines didn’t reference whether Clark could have been handed the baby.

Clark is reportedly being investigated for participating in the Trump rally.

The Department of Defense has a policy against active-duty members participating in political events.
