<p>MADISON, Wis. — A Wisconsin judge has approved an agreement by lawyers to destroy the assault-style rifle that Kyle Rittenhouse used to shoot three people during a 2020 street protest.</p>
<p>Assistant District Attorney Thomas Binger said the state crime lab would destroy the gun, probably in April.</p>
<p>Judge Bruce Schroeder, the Kenosha County judge who presided over Rittenhouse’s trial, approved the agreement.</p>
<p>Rittenhouse’s attorney had filed a motion asking prosecutors to return Rittenhouse’s rifle, his ammunition, his face mask and other clothing he was wearing the night of the shooting to him.</p>
<p>A spokesman for Rittenhouse said last week that Rittenhouse, who is now 19, wanted to destroy the rifle so nothing can be used as a political symbol or trophy celebrating the shootings.</p>
<p>Late last year, Rittenhouse was found not guilty on all counts in connection with three shootings that took place amid protests against police brutality in the wake of the police shooting of Jacob Blake. Two people were killed and a third person was injured.</p>
<p>Rittenhouse was 17 and had traveled state lines to patrol the protests. Jurors found that he had fired his weapon in self-defense.</p>
<p>Rittenhouse had faced charges of first-degree intentional homicide, first-degree reckless homicide, attempted first-degree intentional homicide and two counts of first-degree recklessly endangering safety.</p>

<p>Over the last two years, we’ve seen a rise in social justice movements dealing with race and policing.</p>
<p>These issues took center stage this year in high-profile court cases, and experts say they could have an impact on legislation and elections in 2022.</p>
<p>In 2021, we saw trials, stemming from the deadly police incidents that sparked protests.</p>
<p>The convictions of former Minnesota police officers Derek Chauvin and Kim Potter grabbed the nation’s attention. A jury found Chauvin guilty on all charges in the death of George Floyd. A jury found Potter guilty of manslaughter in the death of Daunte Wright.</p>
<p>"This is certainly the year where we’re seeing some type of police accountability," said Jason Williams, an associate professor of Justice Studies at Montclair State University.</p>
<p>He said these verdicts will keep social justice in the spotlight for 2022</p>
<p>However, Williams said another big verdict - the acquittal of Kyle Rittenhouse - is sure to have an impact in the new year, too.</p>
<p>"It seems to give the green light to far-right vigilantes to attend these types of demonstrations," he said. "We may see more of those instances."</p>
<p>Rittenhouse successfully claimed self-defense after shooting and killing two people in Kenosha, Wisconsin and injuring a third during civil unrest following a police shooting.</p>
<p>"I think going into the next year we really need to pay closer attention to it, especially given the Rittenhouse verdict," Williams said.</p>
<p>The professor also predicts it could bring proposals for changes to gun laws and even self-defense laws at the state level in the new year.</p>
<p>"It's hard to decipher sometimes between the rhetoric, meaning like is the politician just going to sprout rhetoric or are they actually going to do something about it," Williams said.</p>
<p>When it comes to the 2022 midterm elections, Williams said all of these cases will continue to play out in a big way.</p>
<p>"Unfortunately, policing issues continue to be a very big political wedge and both parties will tend to use them to their advantage to gain some type of movement with their base," he said.</p>
<p>There’s another big topic leading up to the midterms.</p>
<p>"Voter rights are being shown to be sort of the quintessential issue, especially as the January 6th fiasco continues to unravel," Williams said.</p>
<p>Williams said political parties will likely rally even more to get supporters to the polls.</p>
<p>He adds other social justice issues like the student loan debt crisis, the fight over K-12 education curriculum and women’s rights will likely get more attention in 2022 as well.</p>
<p>"I do think going into this next year there’s going to be some pressures from all kinds of advocacy groups,” Williams said.</p>

<p>CINCINNATI — A Kenosha, Wisconsin, jury found Kyle Rittenhouse not guilty on all counts in connection with an August 2020 shooting that killed two men during protests against police brutality.</p>
<p>The case ignited debates on gun rights and self defense across the country, with Hamilton County prosecutor Joe Deters saying the then 17-year-old "would've never been charged" if the shooting happened in the area.</p>
<p>Rittenhouse faced intentional and reckless homicide charges, as well as recklessly endangering safety. Deters said the law for self defense is clear, and said he believes the prosecutor overseeing the case acted irresponsibly to bring charges.</p>
<p>"[The] prosecutor is either spineless or an idiot," Deters said. "It's embarrassing to prosecutors around the country — know the law, know how it should be even-handed. No matter who is being shot, who shoots, that's not the issue. What color they are, if they're gay, it doesn't matter."</p>
<p>Deters said it is clear Rittenhouse acted to protect himself, something attorney Carl Lewis agrees with. </p>
<p>"I think he responded to what he thought was a threat," Lewis said. "You have the right to bear arms."</p>
<p>Lewis said the Rittenhouse trial came down to reasonable doubt.</p>
<p>"[I'm] shocked and not shocked," Lewis said. "Surprised he wasn't convicted of a lesser. Not shocked from a lawyer's perspective, because it's proof beyond a reasonable doubt. That case was filled with reasonable doubt."</p>
<p>Lewis said Rittenhouse carrying a loaded gun to Kenosha amid protests might have been a recipe for disaster, but it does not mean he was criminally reckless.</p>
<p>"He's carrying a weapon, something happens, he defends himself," Lewis said. "I don't think that's reckless. <p>The family of Anthony Huber, a man Rittenhouse killed in the shooting, released a statement shortly after the verdict was read, saying they were "heartbroken" and "angry" he was found not guilty.</p>
<p>"It sends the unacceptable message that armed civilians can show up in any town, incite violence, and then use the danger they have created to justify shooting people in the street," the statement read.</p>

<p>KENOSHA, Wis. — Jacob Blake, the Black man shot by Kenosha police in August 2020, recently told <a class="Link" href="https://www.tmz.com/videos/2021-11-17-111721-jacob-blake-kyle-1309450/" target="_blank" rel="noopener">TMZ</a> that he believes if Kyle Rittenhouse were a different ethnicity, "he'd be gone."</p>
<p>Rittenhouse was found not guilty on Friday on five counts linked to two fatal shootings amid protests against police brutality sparked by the shooting of Blake.</p>
<p>"I do still feel very strongly that if he was a different ethnicity or people/group, he'd be gone. There wouldn't be no 'he's a hero' and this that and the third," Blake told TMZ on Thursday. "They would have said, 'He's underage, he traveled to a different state with a firearm that didn't belong to him.'"</p>
<p>Rittenhouse and his defense team argued the then 17-year-old fired an AR-15 style rifle in self-defense. Prosecutors argued Rittenhouse was the instigator and aggressor in the incident.</p>
<p>Blake was shot last August when Kenosha police responded to a domestic incident. Kenosha police officer Rusten Sheskey shot Blake seven times in the back, paralyzing Blake from the waist down.</p>
<p>Police say they thought Blake was reaching for a knife. Sheskey was not criminally charged for the incident.</p>
<p>Blake's supporters have fought back against the narrative that he was a threat to the officers.</p>

<p>During the TMZ interview, Blake was asked about the role of race in the Rittenhouse shooting.</p>
<p>"The high fives, he was caught throwing up the Aryan nation [hand sign], the judge seems like he really likes the guy [Rittenhouse]," he said. "Honestly the kid [Rittenhouse] might not be a bad person. I'm not saying he's a bad person at all, but what he did — he shouldn't have been there. He shouldn't have been there."</p>

<p>Blake mentioned he turned 30 years old this year. He added he was born the same year that the police beating of Rodney King was videotaped, sparking riots in Los Angeles.</p>
<p>"It's just ironic 30 years later, here I am," Blake said.</p>
<p>Blake then returned to the topic of Rittenhouse.</p>
<p>"We know that he shouldn't have been out there," he said. "No matter if these people tried to kick him in the face, hit him with a skateboard, and there was even a guy he shot in the arm. The other guy had a gun — he didn't even shoot him. He could have opened fire on him easily. You know he was right there. He chose not to shoot him. The guy that he shot seems like a very stand up individual."</p>

<p>KENOSHA, Wis. (AP) — Kyle Rittenhouse’s attorneys have asked the judge to declare a mistrial before the jury reaches a decision, saying the defense received an inferior copy of a key video from prosecutors.</p>
<p>Defense attorney Corey Chirafisi told Judge Bruce Schroeder on Wednesday that the defense would have approached things differently if it had received the higher quality video earlier.</p>
<p>Chirafisi says the request would be made “without prejudice,” meaning prosecutors could try Rittenhouse again if the judge were to grant the request.</p>
<p>Prosecutors countered that the jury saw the highest-quality version of the video during the trial and it was played without objection.</p>
<p>Schroeder did not immediately rule on the mistrial request.</p>
<p>The jury is continuing to deliberate. They were handed the case Tuesday after two weeks of testimony in which they were given starkly different portrayals of Rittenhouse's actions the night he shot three men on the streets of Kenosha.</p>
<p>Rittenhouse, then 17, shot two men to death and wounded a third during a tumultuous night of protests against racial injustice in the summer of 2020.</p>
<p>Prosecutors say Rittenhouse was a “wannabe soldier” who provoked a confrontation, while the defense says he feared for his life and acted in self-defense after being ambushed by a “crazy person.”</p>

<p>Gittings is now back in Kenosha awaiting a verdict in the trial of the man who pulled the trigger, 18-year-old Kyle Rittenhouse.</p>
<p>Tuesday saw tense moments outside of the Kenosha County Courthouse. For Gittings, it brings back feelings of when she last saw her boyfriend.</p>
<p>"It's been more dramatic than I thought it was going to be. We all knew the trial was coming, obviously," Gittings said.</p>
<p>Rittenhouse's defense team says Huber attacked Rittenhouse with a skateboard, and Rittenhouse killed Huber in self-defense. The prosecution and Gittings said Huber was trying to disarm Rittenhouse.</p>
<p>Gittings said she expected Huber's actions to be more of a focus during the trial.</p>

<p>"I just feel he was so underrepresented in this trial and I don't think that's fair, because what he did was assess an active-shooter situation, and he was just that type of man," Gittings said. "If he could've gotten that gun away, he would've held on to it. I don't think he would've thrown it. But clearly his main goal was to just stop this kid from doing what he just done, which was murdering Joseph Rosenbaum."</p>
<p>Rittenhouse faces charges of first-degree intentional homicide, first-degree reckless homicide, attempted first-degree intentional homicide, two counts of first-degree recklessly endangering safety and failure to comply with an emergency order. He faces life in prison if convicted of the intentional homicide count.</p>

<p>KENOSHA, Wis. — The Kenosha County Sheriff's Department and Kenosha Police Department say there is <a class="Link" href="https://www.tmj4.com/news/kyle-rittenhouse-trial/no-reason-to-close-roads-enact-curfew-ahead-of-rittenhouse-verdict-kenosha-county-sheriffs-department-says" target="_blank" rel="noopener">no reason to close roads or enact a curfew</a> ahead of a verdict being returned in the trial of Kyle Rittenhouse, according to a joint statement issued Tuesday.</p>
<p>"At this time, we have no reason to facilitate road closures, enact curfews or ask our communities to modify their daily routines," the statement said.</p>
<p>The joint statement goes on to say that the two agencies "understand and recognize the anxiety" surrounding the trial but that such measures are not needed, at least not now.</p>
<p>"Our departments have worked together and made coordinated efforts over the last year to improve response capabilities to large-scale events," the statement says. "We have also strengthened our existing relationships with State and Federal resources."</p>
<p>The statement concluded by saying both agencies will continue to be engaged with community leaders about the trial.</p>
<p>Wisconsin Gov. Tony Evers has already called on the <a class="Link" href="https://www.wrtv.com/news/national/governor-authorizes-national-guard-to-support-kenosha-ahead-of-rittenhouse-verdict">Wisconsin National Guard</a> to assist local law enforcement in anticipation of potential unrest in the city following the jury's decision.</p>
<p>The jury in Rittenhouse's trial began deliberations Tuesday morning after a full day of closing arguments and jury instructions on Monday.</p>

<p>The judge had Rittenhouse draw slips from a raffle drum to select alternate jurors who will be dismissed before deliberations. Eighteen jurors sat through two weeks of testimony.</p>
<p>The jurors must decide if Rittenhouse is responsible for the deaths of the two protesters he shot on Aug. 25, 2020, amid at times violent demonstrations against police brutality following the police shooting of Jacob Blake.</p>
<p>Rittenhouse faces charges of first-degree intentional homicide, first-degree reckless homicide, attempted first-degree intentional homicide, and two counts of first-degree recklessly endangering safety. He faces life in prison if convicted on one of the intentional homicide counts.</p>

After that, the two sides were expected to deliver closing arguments, the final word before the jury was to begin deliberations.Rittenhouse, 18, killed two men and wounded a third in the summer of 2020 during a turbulent protest against racial injustice, in a case that has underscored bitter division in the U.S. over guns, protests and law and order.He faces a mandatory sentence of life in prison if convicted of the most serious charge against him, first-degree intentional homicide.The underage weapon charge was punishable by up to nine months in jail.There is no dispute that Rittenhouse was 17 when he carried an AR-style semi-automatic rifle on the streets of Kenosha and used it.But the defense argued that Wisconsin law had an exception that could be read to clear Rittenhouse. After prosecutors conceded on Monday that Rittenhouse’s rifle was not short-barreled, Judge Bruce Schroeder dismissed the charge.Public interest in closing arguments was evident Monday morning, when more people than usual stood in a line outside Courtroom 209 to get a seat. <p>The judge at Kyle Rittenhouse’s murder trial on Monday dismissed a count of possession of a dangerous weapon by a person under 18, a misdemeanor that had appeared to be among the likeliest of the charges to net a conviction for prosecutors.</p>
<p>The judge then launched into 36 pages of legal instructions to the jury, explaining the charges and the laws of self-defense. After that, the two sides were expected to deliver closing arguments, the final word before the jury was to begin deliberations.</p>

<p>Rittenhouse, 18, killed two men and wounded a third in the summer of 2020 during a turbulent protest against racial injustice, in a case that has underscored bitter division in the U.S. over guns, protests and law and order.</p>
<p>He faces a mandatory sentence of life in prison if convicted of the most serious charge against him, first-degree intentional homicide.</p>
<p>The underage weapon charge was punishable by up to nine months in jail.</p>
<p>There is no dispute that Rittenhouse was 17 when he carried an AR-style semi-automatic rifle on the streets of Kenosha and used it.</p>
<p>But the defense argued that Wisconsin law had an exception that could be read to clear Rittenhouse. After prosecutors conceded on Monday that Rittenhouse’s rifle was not short-barreled, Judge Bruce Schroeder dismissed the charge.</p>
<p>Public interest in closing arguments was evident Monday morning, when more people than usual stood in a line outside Courtroom 209 to get a seat. The first one in line was a man in a red hat and red coat bedecked with silver glitter. Outside, someone erected a cutout of Rittenhouse, and a man stood on a corner waving an upside-down American flag.</p>
<p>Rittenhouse's mother, Wendy Rittenhouse, listened intently in court during the jury instructions.</p>
<p>Rittenhouse traveled the few miles from his home to Kenosha on Aug. 25, 2020, as the city was in the throes of damaging protests that erupted after a white police officer' shot and wounded Jacob Blake, a Black man. He said he went there to protect property.</p>

<p>After fierce debate between prosecutors and attorneys for Rittenhouse, Judge Bruce Schroeder said he would issue final rulings on Saturday about which lesser charges the jury could consider. </p>
<p>Rittenhouse faces five felony charges stemming from the shooting amid protests in Kenosha, Wisconsin following the police shooting of Jacob Blake.</p>
<p>The jury was not in the courtroom for Friday's debate. They will return Monday for closing arguments. </p>

<p>Members of the National Guard will stage outside Kenosha in a standby status to respond if requested by local law enforcement agencies, officials say. The Rittenhouse trial has entered its final stages.</p>
<p>“We continue to be in close contact with our partners at the local level to ensure the state provides support and resources to help keep the Kenosha community and greater area safe,” said Gov. Evers. “The Kenosha community has been strong, resilient, and has come together through incredibly difficult times these past two years, and that healing is still ongoing. I urge folks who are otherwise not from the area to please respect the community by reconsidering any plans to travel there and encourage those who might choose to assemble and exercise their First Amendment rights to do so safely and peacefully.”</p>
<p>Maj. Gen. Paul Knapp, Wisconsin's adjutant general, said the National Guard is ready to support communities during times of need.</p>
<p>“In close coordination with the governor, we have assembled approximately 500 soldiers to help keep the Kenosha community safe, should a request from our local partners come in," Knapp said. </p>
<p>Prosecutors and defense attorneys for Rittenhouse returned to the courthouse without the jury present on Friday to finalize how jurors will be instructed when they get the case next week and begin deliberating.</p>
<p>Jury instructions will be worked out on Friday, and closing arguments are expected on Monday.</p>

<p>KENOSHA, Wis. — The prosecution rested its case Tuesday in the <a class="Link" href="https://www.tmj4.com/news/kyle-rittenhouse-trial/watch-live-day-6-of-kyle-rittenhouse-trial" target="_blank" rel="noopener">trial of Kyle Rittenhouse</a>, the 18-year-old accused of shooting three protesters — two of them fatally — during demonstrations against police brutality following the shooting of Jacob Blake in Kenosha in August 2020.</p>
<p>Over five-and-a-half days, the prosecution attempted to paint Rittenhouse as the aggressor in the incidents that led to the deaths of Joseph Rosenbaum and Anthony Huber.</p>
<p>On Tuesday, Dr. Doug Kelley of the Milwaukee County medical examiner's office testified that Rosenbaum, the first man killed by Rittenhouse, was shot at close range of just a few feet. He also said Rosenbaum had soot injuries that could indicate he had his hand over the barrel of Rittenhouse's gun.</p>
<p>However, Kelley said it was unclear from video footage whether Rosenbaum was grabbing for Rittenhouse's gun or trying to swat it away.</p>
<p>His testimony came after the jury watched a drone video that showed Rittenhouse wheeling around and shooting Rosenbaum at close range.</p>
<p>On Monday, Gaige Grosskreutz — who survived after being shot by Rittenhouse — took the stand and testified that he thought he was going to die after being shot by Rittenhouse. Under cross-examination, he testified that Rittenhouse had only shot him after he pointed his own weapon at Rittenhouse.</p>
<p>Lawyers for Rittenhouse began presenting their case to the jury Tuesday afternoon. According to <a class="Link" href="https://www.cnn.com/2021/11/09/us/kyle-rittenhouse-trial-tuesday/index.html">CNN</a>, the defense called four people to testify, including two people who were armed on the night of the shooting in Kenosha.</p>
<p>Nicholas Smith claimed that the owners of a car dealership asked them to protect his business. However, the owner of the dealership testified earlier that he never asked for their protection, CNN reports. </p>
<p>Rittenhouse faces five felony charges: first-degree intentional homicide, first-degree reckless homicide, attempted first-degree intentional homicide, and two counts of first-degree recklessly endangering safety. He faces life in prison if convicted on one of the homicide counts against him.</p>

The one-time police youth cadet from Antioch, Illinois, was 17 when he went to Kenosha with an AR-style rifle and a medical kit in what he said was an effort to safeguard property from the demonstrations that broke out over the shooting of Jacob Blake, a Black man, by a white Kenosha police officer.Rittenhouse is white, as are the three men he shot, but the case has  raised polarizing questions about racial justice, policing, firearms and white privilege.In the first week of Rittenhouse's trial, prosecutors played numerous videos  that showed the events of that night from different angles. Jurors heard testimony from people who were with Rittenhouse, as well as from police officers and loved ones of the men who died. Jason Lackowski, a former Marine who was on the streets of Kenosha carrying his own rifle, testified Friday about Rosenbaum, the first man Rittenhouse shot. Lackowski said Rosenbaum was acting "belligerently"  but did not appear to pose a serious threat. Lackowski said he considered Rosenbaum a "babbling idiot," and turned his back and ignored him. He acknowledged that he didn't see everything that went on between Rittenhouse and Rosenbaum, including their final clash.Other witnesses testified last week that a "hyperaggressive" Rosenbaum angrily threatened to kill Rittenhouse that night and that Rosenbaum was gunned down after he chased Rittenhouse and lunged for his rifle.Prosecutors have portrayed Rittenhouse as the instigator of the bloodshed as well as an inexperienced teen who misrepresented his age and medical training to others that night. <p>A juror who had been selected to decide the fate of Kyle Rittenhouse was <a class="Link" href="https://www.tmj4.com/news/kyle-rittenhouse-trial/watch-live-day-3-of-rittenhouse-trial-begins" target="_blank" rel="noopener">dismissed from the trial Thursday</a> after it was revealed he had made a joke about the police shooting of Jacob Blake to a sheriff's deputy earlier this week.</p>
<p>Rittenhouse is currently being tried on several felony homicide counts linked to a shooting that left two people dead amid protests that sprung up in Kenosha, Wisconsin, following Blake's shooting in August 2020.</p>
<p>According to Scripps station TMJ4 in Milwaukee, Assistant District Attorney Thomas Binger said Thursday that the juror told the deputy, "Why did Kenosha Police shoot Jacob Blake seven times? They ran out of bullets."</p>
<p>Bringer claimed that the statement showed racial bias.</p>
<p>Judge Bruce Schroeder then dismissed the juror from the 12-person panel.</p>
<p>"The public needs to be confident this is a fair trial," Schroeder said. </p>
<p>He added the joke showed "at the very least, bad judgment."</p>
<p>On Monday, Rittenhouse's trial opened with the selection of 20 people to serve as jurors — 12 regular jurors and eight alternates. One of the alternates will presumably take the dismissed juror's place.</p>
<p>Rittenhouse was 17 when he traveled from his home in northern Illinois to Kenosha during the protests. He claims he went to Kenosha to help business owners protect against looting that was taking place amid the protests.</p>
<p>During the protests, Rittenhouse shot and killed protesters Anthony M. Huber and Joseph Rosenbaum during those demonstrations and injured one other person. His defense team has argued that he fired in self-defense after protesters surrounded him.</p>

<p>MADISON, Wis.— A Wisconsin judge has set the final ground rules for what evidence will be allowed at Kyle Rittenhouse's trial next week.</p>
<p>Judge Bruce Schroeder, during a hearing Monday, ruled that the two men who were shot and killed by Rittenhouse amid August 2020 protests against police brutality could not be referred to by attorneys as "victims" during the upcoming trial.</p>
<p>Schroeder explained it's his long-held view that lawyers should not use the word "victim" to describe people during trials. According to <a class="Link" href="https://www.npr.org/2021/10/26/1049458617/kyle-rittenhouse-victims-arsonists-looters-judge-ruled" target="_blank" rel="noopener">NPR</a>, while such a view is not universal, other judges across the country often rule against the use of the term "victim" because it presupposes a defendant's guilt.</p>
<p>Schroeder also said Tuesday that Rittenhouse's lawyers could potentially refer to the men shot by the teenager as shot as "rioters" or "looters."</p>
<p>"Let the evidence show what the evidence shows — that any or one of these people were engaged in arson, rioting or looting — then I'm not going to tell the defense they can't call them that," Schroeder said, according to <a class="Link" href="https://www.cnn.com/2021/10/27/us/kyle-rittenhouse-trial-victim-terminology/index.html" target="_blank" rel="noopener">CNN</a>.</p>
<p>The judge on Tuesday also ruled that defense attorneys could introduce a video of police thanking Rittenhouse for protecting city businesses and offering him water. The attorneys argue that shows police felt Rittenhouse was acting reasonably. </p>
<p>Schroeder also ruled that a defense use-of-force expert can testify, but only about how quickly the shootings occurred.</p>
<p>Rittenhouse, who was 17 at the time, traveled across state lines from his home state of Illinois to Kenosha, Wisconsin, in August 2020 as protests against police brutality gripped the city.</p>
<p>The teenager has said he traveled to Kenosha to help business owners protect against looting that was taking place amid the protests. During those protests, Rittenhouse shot and killed protesters Anthony M. Huber and Joseph Rosenbaum and injured one other person.</p>
<p>Rittenhouse has argued that he fired in self-defense after protesters surrounded him.</p>
<p>The trial is set to begin Nov. 1.</p>
