La Dallas Mitchell is working overtime to care for her daughter.

"It's just been nonstop," Mitchell said. "She's probably been sick like five times."

At the same time, parenting means working around that sickness.

The U.S. is the only developed country that does not guarantee any paid sick leave, according to the Center for Economic Policy and Research, though some states like New York, New Jersey and California have laws with requirements.

Medical experts say the surge of viruses right now highlights the need for paid sick time off.

"With RSV, COVID and the flu, this is very taxing to the health care system but also taxing to our families," said Dr. Willie Underwood, with the American Medical Association. "People get sick and ill; they can't work. They have increased health care costs. It's detrimental to us."

In October, a record high 104,000 Americans missed work due to "childcare problems," according to the Bureau of Labor Statistics.

A recent Robert Wood Johnson Foundation report found workers lost $28 billion in wages during 2020 to 2022. Women, Latino, and Black workers felt the brunt of it. It also found people making less than $25,000 a year were about 2.5 times more likely to not have paid sick leave compared to someone making $100,000.

Epidemiologist and research director Mona Shah worked on the foundation report.

"For a family member who had to take off a week of work to take care of themselves or their child, that meant they lost an average of $815 in wages," Shah said. "That would have huge implications for paying for food, housing, health care, gas and other essentials."

Shah says when someone works while they or a loved one is sick, it impacts more than that single household.

"They're working when they're sick, and they're potentially impacting the people that they come across, whether at work or at school, and so it's really a compounding effect," Shah said.

She said that's why paid time off is important for a community to stay healthy, especially during busy holiday seasons.

Heidi Prodoehl might know the inside of Froedtert's transplant center in Milwaukee better than anyone else."I'm just, like, interconnected multiple ways," she told sister station WISN. The West Bend wife and mom of two young kids has been a transplant nurse at Froedtert for more than a decade. But on this particular day in December, she's not the one checking the vitals; she's a patient, bringing WISN with her exclusively to her first post-op appointment after getting a kidney transplant."She would be kind of a poster child of people who come in and do well," said Froedtert surgeon, Dr. Terra Pearson. "She would be the poster child. She's doing amazing.""I'm doing really well," Prodoehl said. "I got my drain taken out. I got a staple taken out because the wound is looking really good."Earlier this month, Prodoehl was wheeled off the same floor she works to cheers from colleagues who have become much more."They're my family. They know everything. They were well-informed about everything going on. They knew ahead of time," Prodoehl said.WISN first introduced us to Prodoehl in 2020 when she found herself on the transplant list for the second time in her life. Born with a rare genetic disorder, she needed her first transplant, a new liver, in 2005.Christmas came early this month when just days before starting dialysis, a match was found."The night actually, I got the call and came in, everyone was like running down the hallways, excited and congratulating and hugging me. And I was so happy, so happy. It was me that was coming in for this organ," she said.Back on the mend, but not quite back to work, she's using the recovery time to share her story of the importance of organ donation."Yes, like Christmas. Especially right now, like, this is amazing because, you know, that person or whoever, whoever that was, I wouldn't be sitting here today talking to you guys had it not been for them. When Patrick Kennedy was in Congress, he would sneak in his treatments for substance abuse over the holidays, in between congressional work periods. And he refused mental health treatment recommended by his doctors, worried he would be recognized in that wing of the hospital.

Kennedy, a Rhode Island Democrat and the son of the late Edward Kennedy, was eventually forced to reveal his struggles when he crashed his car outside the Capitol while intoxicated in May 2006. He talked openly about his mental health and substance abuse for the first time, and something surprising happened — he became more popular with his constituency, winning reelection by a bigger margin than he had two years earlier.

On Thursday, the office of Pennsylvania Sen. John Fetterman, a Democrat who was elected to the Senate after a bruising campaign during which he suffered a stroke, announced he had checked himself into the hospital for clinical depression. The statement said Fetterman had experienced depression on and off in his life, but it had only become severe in recent weeks.

Fetterman's public struggle is extraordinary in a building where few talk about their own mental health, even while members of both parties have legislation to expand aid for it. Kennedy and a handful of others who have been open about their own problems, or those in their family, say they hope Fetterman's honesty — and his decisive action to get help — will foster more openness among lawmakers and their constituents in the wake of a global pandemic that has had far-reaching effects.

"This is a moment for us to tear down the stigma of depression and anxiety," said Kennedy, who retired in 2010 and has become a leading voice on mental illness. "Sen. Fetterman may do more for people just by admitting that he's getting help for depression than any bill he ends up sponsoring."

The U.S. Surgeon General, Vivek Murphy, tweeted praise for Fetterman, saying he hopes his "courage will serve as an example for others."

Fetterman's Senate colleagues were immediately supportive.

"In every single city and town and rural community there is someone struggling with mental health," said Minnesota Sen. Tina Smith, a Democrat who shared her own stories about periods of depression on the Senate floor four years ago. "If they see somebody else, like John, saying, 'OK, I need to get medical care,' that can be important to people."

South Dakota's John Thune, the Senate's No. 2 Republican, said he thinks politicians have become more comfortable discussing the issue since the pandemic.

"The more open, transparent people can be, the better our understanding is," Thune said.

Fetterman's hospitalization comes after a rough year in which the 53-year-old suffered a stroke just ahead of the May primary election and spent much of the summer off the campaign trail, recovering. He has said the stroke nearly killed him. He also underwent surgery to implant a pacemaker with a defibrillator to manage two heart conditions, atrial fibrillation and cardiomyopathy. He entered the Senate in January, where he has had to adjust to life in Washington and the daily grind of a federal lawmaker.

"It's unreal what @JohnFetterman has been through in the last year," tweeted Sen. Chris Murphy, D-Conn. "A stroke, a recovery, a bruising campaign, a transition to the Senate. I'm so proud of him for taking his health seriously. He's going to be a great Senator for a long time, and I'm pulling for him today."

Texas Sen. John Cornyn said the Senate "can be arduous. So I'm sure if somebody is not up to 100% then it's especially tough, so I wish him well."

Post-stroke depression is common, doctors say. And that could be even more difficult when dealing with it publicly, like Fetterman is.

"Having a stroke in and of itself is devastating and having to recover from a stroke in the public eye only adds to the level of stress as one recovers," said Dr. Bruce Ovbiagele, associate dean and professor of neurology at the University of California-San Francisco.

Dr. Eric Lenze, head of the Department of Psychiatry at Washington University in St. Louis, said he thinks it's "interesting and heroic" for a major political figure to acknowledge depression, "instead of saying they're hospitalized for exhaustion or trying to hide it."

While many members are still loath to talk about themselves or their own hardships, some have been more forthcoming about mental illness in recent years. Pennsylvania Rep. Susan Wild declared from the House floor in 2019 that suicide is a "national emergency" and told the story of her partner, who had recently taken his own life. Rep. Ritchie Torres, D-N.Y., who was elected in 2020, has said he dropped out of college and at times thought of suicide after struggling with depression, substance abuse and grief after the loss of a friend. Smith said she found that ever since she told her own story of periods of depression as a college student and young mother, people still come up to her to talk about it.

Many lawmakers have also been open about their fear and anxiety after the Jan. 6, 2021, Capitol insurrection, when many of them ran for their lives, and the months afterward when tensions between the two parties became even worse. Democratic Reps. Dan Kildee of Michigan and Annie Kuster of New Hampshire both talked about dealing with post-traumatic stress during that time.

The Jan. 6 attack was another inflection point amid the global pandemic.

"We're living in a time of extraordinary stress and crisis," said Maryland Rep. Jamie Raskin, who lost his son to suicide just a few days before the insurrection and has since written a book about his experience. "We've come through a plague, we've had tremendous mental and emotional health problems."

Raskin, who was recently diagnosed with cancer, says there may have been a time when political leaders had to pretend that hardships didn't touch their own families, "but I don't think we are living in that time."

Illinois Sen. Dick Durbin, who has been in the Senate for almost three decades, credits returning veterans from the Iraq war and other conflicts "who have convinced us that this is simple medical, mental health care that many people need from time to time. There isn't a single family that isn't touched by it."

Durbin, the No. 2 Senate Democrat, credited Fetterman for being honest. "This is a challenge, unimaginable challenge, that he's faced in life," Durbin said.

Kennedy says that when he returned from his recovery in the mid-2000s, many of his colleagues sought his help and advice privately. And he has continued to talk to some members in the decade since he retired.

He predicted Fetterman could find a "whole new world of connection with his constituency" when he returns to the Senate, and could help people understand the brain science behind depression.

"This is a very teachable moment here," Kennedy said.

When you think of therapy animals, you probably don't think of Great Danes, which are bigger than some horses.

But they are a big hit at a Minnesota hospital. Pun intended.

“If a nurse isn't aware of us coming in, doesn't know that the dogs are that big, they've been scared, Wayne Chmelik.

Chmelik brings Hulu and Tootsie, his two Great Danes, they have to avoid narrow spaces.

But despite their size, the dogs are about as friendly as they come.

“They are [friendly]. Unless you were a squirrel. Yes, they are just the most gentle animals that I’ve ever raised,” Chmelik said.

Hulu weighs 170 pounds and Tootsie weighs 166, both towering over the miniature horses in the local therapy animal association.

A while back, Hulu made friends with 3-year-old Nellie Koubsky, who briefly stayed in the hospital for appendicitis.

"Why did you come to the hospital, do you remember?” Rachel Koubsky, Nellie’s mom, asked her daughter.

“Because my tummy hurt,” Nellie said.

But just before the surgery, the biggest and friendliest dog Nellie had ever seen paid her a visit.

“Did he help you feel better?” Rachel Koubsky asked.

“Yeah,” Nellie responded.

“For a little bit?”

“Yeah, he was just cheering me up.”

LAS VEGAS — Las Vegas police report 14 people were shot inside a hookah lounge overnight and that one person has died and two others are in critical condition.

Officers responded to the shooting around 3:15 a.m. The shooter or shooters left before officers arrived, police say.

The identity of the deceased will be released by the coroner's office.

Authorities call this an isolated incident and say there is no threat to the public at this time, though they are looking for the suspects.

As the number of COVID-19 cases continues to decline, there's growing concern about another condition that's on the rise. It's called multisystem inflammatory syndrome and it's still a risk among children who also contract COVID-19.

Most doctors will tell you we're not out of the woods yet with COVID-19. While it's encouraging to see case numbers and hospitalizations going down, doctors at Children's Mercy Hospital in Kansas City, Missouri, are seeing cases of multisystem inflammatory syndrome go up. It's a syndrome that takes hold after recovering from COVID-19.

“You can still develop this huge inflammatory response, you know, a few weeks later,” Children’s Mercy Hospital Dr. Angela Myers said. “Which can affect the liver, the heart, the lungs, the kidneys, develop a rash and high spiking fevers,”

Myers said the syndrome didn't seem to be a problem with the delta variant, but omicron is different. Multisystem inflammatory syndrome cases have again risen to what they were before there was any vaccine available.

“Even though a young child might not have significant symptoms with a COVID-19 infection, they are at risk for developing this multisystem inflammatory syndrome later,” Myers said.

That's why doctors are pushing for more children to get vaccinated and to keep COVID-19 prevention methods in place.

Children under the age of 5 could be eligible to receive Pfizer's COVID-19 vaccine by the end of the month if Food and Drug Administration regulators give the OK.

So far, 22% of elementary-aged kids are fully vaccinated. That's compared to a little more than half of 12 to 17-year-olds.

OMAHA, Neb. —

A Nebraska native nearly lost both her parents to COVID-19 at the same time.

Traci Pribyl, of Omaha, was on a ventilator for a month. Her husband, Robert, was in a hospital bed of his own trying to fight off the virus.

A routine doctor's appointment for 71-year-old Robert Pribyl led to a COVID-19 diagnosis. It was early November. His doctor asked him to come back a couple of days later for a check-up, then immediately admitted him to the hospital.

"I felt weak, real weak,” he said.

Little did he know, his 55-year-old wife Traci was home alone with the virus, and deteriorating fast.

Their daughter flew in from Florida when Traci stopped answering texts.

She had a nurse come by to give her mom an IV.

“She had given Traci fluids and they said her vitals were horrible and so she called the squad. I believe that is what saved her life,” Robert said.

Traci was rushed to the ER. Both Pribyls were now in the hospital fighting the virus.

“I just told her, I said, 'mom, you're not doing so good. And I need you to be strong for me, because I’m trying, and I can't hold it together. But they're going to have to put you to sleep. Your body needs to rest,” Kirstin Pribyl said.

Traci spent the next month on a ventilator.

Kirstin said it was moment by moment for both parents.

"It is so traumatic. I just can’t stress that enough. It's very traumatic to watch this, to go through this, to make these decisions. I definitely thought that my world was going to start crashing down on me,” Kirstin said.

Robert went home in two weeks. Traci was released Dec. 6.

Even though he's older, Robert believes he was better off because of one thing.

“She was not vaccinated, and I was,” Robert said. “But I am now,” Traci added.

“They say it's not so bad if you're vaccinated. You can still catch it but you don’t have the severity of the disease,” Robert said.

Traci said she wasn't sure about the vaccine and held off on getting it. She said that decision was “stupid.”

“I don’t want to say I was cocky and invincible and that it wouldn’t happen to me, because everybody’s number is going to be pulled at some point, but I just didn’t realize it would be this bad and I would be in delirium,” she said.

She said doctors told her it could take up to two years to fully recover. She said she doesn’t remember even taking Robert to the hospital, nor the entirety of her illness, until doctors were taking the tube out of her body.

She's still waiting for her voice to come back.

They encourage others to just get the shot.

CINCINNATI — At least seven hospitals in southwest Ohio have been at capacity during the first two weeks of 2021 as COVID-19 cases continue to surge in the Tri-State.

EMS crews and dispatchers working during the pandemic have been forced to divert patients as they try to provide the best service possible under extreme conditions. Diversions are used when hospitals are at capacity, but will still accept the most serious cases.

Hamilton County Communications Center records show the University of Cincinnati Medical Center was at capacity for up to 16 hours a day Jan. 1-5. At least three hospitals in southwest Ohio were at capacity on the same day Jan. 2, 3, 5, 10 and 11.

If one facility says it is at capacity, a notification goes out to ensure other places with staff and space can prepare for paramedics with patients. It allows the facility under duress to take a breath and continue to provide care for existing cases, but health officials say few are able to actually take a breath.

Tiffany Mattingly, vice president of The Health Collaborative's clinical strategies, says their "at capacity" designations are at an all-time high.

"This is the most stretched I've seen the hospitals in my experience in this position," Mattingly said.

On Jan. 4, Good Samaritan Hospital was "over capacity" for about seven hours — the only hospital in the region listed as over capacity so far in 2022.

This week has been particularly challenging at Mercy Health - Clermont Hospital, which was at capacity for part of each day Jan. 10-14. In some cases, hospitals were at capacity for less than one hour. On other days, hospitals were at capacity for most of the day.

Mattingly said staffing is the biggest problem for hospitals now, as health care workers are "just as susceptible" to COVID as everyone else. The problem has created similar conditions at medical centers around the country.

While hospitals have been at capacity, they do not say no to critical conditions like strokes or heart attacks. Mattingly said they are flexible as possible — and patient load is one reason the Ohio National Guard is helping.

"The important thing is, is that if you need medical care — urgent medical care, the emergency departments are open, they are safe, and they are ready to care for you," Mattingly said.

U.S. doctors have transplanted a pig heart into a patient in a last-ditch effort to save his life — a first for medical science.

Doctors at the University of Maryland School of Medicine said Monday the patient is doing well three days after surgery.

The patient is 57-year-old David Bennett, a Maryland handyman too sick to get a human heart.

Bennett said before the surgery: “I want to live. I know it’s a shot in the dark, but it’s my last choice.”

Friday’s surgery showed for the first time that a gene-edited animal heart can function in the human body without immediate rejection.

According to USA TODAY, Bennett is breathing on his own without a ventilator. However, he reportedly is still on an ECMO machine that helps pump blood through his body. USA Today says doctors plan to slowly wean him off the machine.

"This was a breakthrough surgery and brings us one step closer to solving the organ shortage crisis. There are simply not enough donor human hearts available to meet the long list of potential recipients,” said Bartley P. Griffith, MD, who surgically transplanted the pig heart into Bennett.

According to the University of Maryland Medical Center, more than 100,000 Americans are currently waiting for an organ transplant, and more than 6,000 patients die each year before receiving a transplant.

Nurse Katie Sefton never thought COVID-19 could get this bad — and certainly not this late in the pandemic.

"I was really hoping that we'd (all) get vaccinated and things would be back to normal," said Sefton, an assistant manager at Sparrow Hospital in Lansing, Michigan.

But this week Michigan had more patients hospitalized for COVID-19 than ever before. COVID-19 hospitalizations jumped 88% in the past month, according to the Michigan Health & Hospital Association.

"We have more patients than we've ever had at any point, and we're seeing more people die at a rate we've never seen die before," said Jim Dover, president and CEO of Sparrow Health System.

"Since January, we've had about 289 deaths; 75% are unvaccinated people," Dover said. "And the very few (vaccinated people) who passed away all were more than 6 months out from their shot. So we've not had a single person who has had a booster shot die from COVID."

Among the new COVID-19 victims, Sefton said she's noticed a disturbing trend.

"We're seeing a lot of younger people. And I think that is a bit challenging," said Sefton, a 20-year nursing veteran.

She recalls helping the family of a young adult say goodbye to their loved one.

"It was an awful night," she said. "That was one of the days I went home and just cried."

'We haven't peaked yet'

It's not just Michigan that's facing an arduous winter with COVID-19. Nationwide, COVID-19 hospitalizations have increased 40% compared to a month ago, according to data from the Department of Health and Human Services.

This is the first holiday season with the relentless spread of the delta variant — a strain far more contagious than those Americans faced last winter.

"We keep talking about how we haven't peaked yet," Sefton said.

Health experts say the best protection against delta is to get vaccinated and boosted. But as of Thursday, only about 64.3% of eligible Americans had been fully vaccinated, and less than a third of those eligible for boosters have gotten one.

Sparrow Hospital nurse Danielle Williams said the vast majority of her COVID-19 patients are not vaccinated — and had no idea they could get pummeled so hard by COVID-19.

"Before they walked in the door, they had a normal life. They were healthy people. They were out celebrating Thanksgiving," Williams said. "And now they're here, with a mask on their face, teary eyed, staring at me, asking me if they're going to live or not."

'The next few weeks look hard'

Dover said he's saddened but not surprised that his state is getting walloped with COVID-19.

"Michigan is not one of the highest vaccination states in the nation. So it continues to have variant after variant grow and expand across the state," he said.

"The next few weeks look hard. We're over 100% capacity right now," Dover said.

"Most hospitals and health systems in the state of Michigan have gone to code-red triage, which means they won't accept transfers. And as we go into the holidays, if the current growth rate that we're at today, we would expect to see 200 in-patient COVID patients by the end of the month — on a daily basis."

And that would mean "absolutely stretching us to the breaking point," Dover said.

"We've already discontinued in-patient elective surgeries," he said. "In order to create capacity, we took our post-anesthesia recovery care unit and converted it into another critical care unit."

'There's a lot of frustration'

Nurse Leah Rasch is exhausted. She's worked with COVID-19 patients since the beginning of the pandemic and was stunned to see so many people still unvaccinated enter the COVID unit.

"I did not think we'd be here. I truly thought that people would be vaccinated," the Sparrow Hospital nurse said.

"I don't remember the last time we did not have a full COVID floor."

The relentless onslaught of COVID-19 patients has impacted Rasch's own health.

"There's a lot of frustration," she said. "The other day, I had my first panic attack ... I drove to work and I couldn't get out of the car."

'We need everybody to get vaccinated'

Dover said many people have asked how they can support health care workers.

"If you really want to support your staff, and you really want to support health care heroes, get vaccinated," he said. "It's not political. We need everybody to get vaccinated."

He's also urging those who previously had COVID-19 to get vaccinated, as some people can get reinfected.

"My daughter's a good example. She had COVID-19 twice before she was eligible for a vaccine," Dover said.

"She still got a vaccine because we know that if you don't get the vaccine, just merely having contracted COVID is not enough to protect you from getting it again. And I know that from personal experience."

And those who are unvaccinated shouldn't underestimate the pandemic right now, Dover said.

"The problem is, it's not over yet. I don't know if people realize just how critical it still is," he said.

"But they do realize it when they come into the ER, and they have to wait three days for a bed. And at that point, they realize it."

BATON ROUGE, La. —

Louisiana Department of Wildlife and Fisheries personnel removed a deer from Our Lady of the Lake Hospital in Baton Rouge Monday afternoon after it entered the hospital and made it to the second floor.

According to LDWF officials, the deer had to be euthanized after sustaining traumatic injuries before entering the hospital. Officials believe the deer had been hit by a vehicle near the Essen Lane hospital.

LDWF officials anesthetized the animal before removing it and taking it to LDWF headquarters in Baton Rouge, but after an examination by LDWF State Veterinarian Dr. Jim LaCour revealed the traumatic injuries, the deer was euthanized.

“The deer was apparently injured in traffic,” LaCour said. “Hospital officials did a great job of subduing the animal then getting in touch with us."

Hospital emergency rooms have been overwhelmed with COVID-19 patients for over a year, but other emergencies are still happening too. Doctors are seeing patients who are sicker and more in need.

“We have seen a lot of patients come in sicker than they ever had before and the reason is that so many of them are fearful of coming to a place where COVID patients are, that they are delaying care for other life-threatening conditions. So, we’ve seen a lot of people come in after having their stroke instead of while they're having a stroke we can intervene on,” said Dr. Don Stader, an emergency physician at Swedish Medical Center.

People are delaying care for their emergencies.

“That anxiety of coming to a place with lots of COVID has kept a lot of people away inappropriately and to the detriment of their health,” Dr. Stader said.

While emergency departments have been battling waves of COVID-19, patients have been foregoing emergency care for conditions and illnesses they may have otherwise gone in for. Now, that backlog is catching up to emergency centers across the U.S.

“During COVID, we had this tremendous decrease in our volume initially, and since that time, what you've seen is a tremendous increase back to, I’d say, baseline numbers,” Dr. Stader said.

The number of patients may be returning to normal, but hospital conditions have not. There are fewer nurses and other hospital staff. And the coronavirus is lingering, affecting thousands of Americans every week.

“It’s the busiest it’s been in emergency medicine and emergency departments in over a decade,” said Dr. Richard Zane, an expert in emergency medicine at UCHealth. “We’re seeing what I believe to be almost two years of neglected health care. So, we’re seeing lots of car accidents, lots and lots of strokes, heart attacks, cancer, skin infections, the routine things that we see in emergency departments except we’re seeing much more of them...and we’re seeing increased severity.”

Dr. Zane said the backlog of regular care has caused this rush of sicker patients.

“We’re finding more advanced stages of everything,” he said. “Every condition when it manifests in an emergency condition gets more severe when that underlying condition is more severe.”

“We are seeing an increase in the number of patients who are having exacerbations of chronic illnesses,” said Dr. Bryce Snow, an emergency medicine physician at Providence Regional Medical Center in Washington.

He said due to shutdowns during the pandemic, regular checkups might also be backlogged.

“There’s a little bit of a backlog in appointments and procedures and screening tests because of everything being shut down temporarily.”

Another factor: life is slowly returning to normal. People are out and more prone to accidents.

“The more the people are out and about, the more their chances are of having a medical emergency,” said Akin Demehin, the Director of Policy at the American Hospital Association.

The association represents thousands of health facilities from small regional hospitals to big medical centers. Demehin said those who might be afraid to seek medical help shouldn’t be.

“Patients that need to come to the emergency department should feel confident in doing so,” he said.

“Don't delay seeking care because you're scared of COVID. We have protocols in hospitals to keep people safe,” Dr. Stader added.

As emergency physicians balance COVID-19 patients and other increasingly severe emergencies, Dr. Stader said continuing regular checkups and seeking help when needed is important.

“Go do it, please do. Because that's how we find and intervene on medical issues before they become emergencies,” he said.

Supreme Court Justice Ruth Bader Ginsburg has been discharged from the hospital after receiving treatment for a possible infection, according to Reuters and NBC.

Ginsburg was admitted to The Johns Hopkins Hospital in Baltimore on Tuesday morning. Both NBC and Reuters report that the 87-year-old Justice is "home and doing well" after the brief hospital stay.

LANCASTER, Calif. — A 37-year-old man who was being treated for COVID-19 is accused of killing his 82-year-old hospital roommate while the elderly man was praying.

Investigators with the Los Angeles County Sheriff’s Department say the younger man, identified as Jesse Martinez, is facing charges of murder with a hate crime enhancement and elder abuse.

Martinez and the 82-year-old victim were housed in a two-person room together at Antelope Valley Hospital on December 17 when the attack happened. Both were receiving treatment for COVID-19 symptoms.

“The suspect became upset when the victim started to pray. He then struck the victim with an oxygen tank,” reads a statement from the sheriff’s department.

The older man died from his injuries the next day. Investigators say the two men did not know each other.

Martinez is scheduled to appear in court at the end of the month.

ALBUQUERQUE, N.M. —

A Los Lunas, New Mexico, father is trying to stay strong for his family after two of his children became critically ill due to the coronavirus.

Over the past few weeks, Jason Baca has called the University of New Mexico Hospital (UNMH) his home.

Two of his sons, 17-year-old Jason Lee Baca and 13-year-old Ayden Baca, are currently fighting for their lives in the facility's pediatric intensive care unit.

It all started Aug. 13 after multiple people within the family of nine started to feel sick and reported similar symptoms, including a runny nose and a headache.

The feeling soon spread to the rest of the household. No one in the family had received a COVID-19 vaccine.

"We were in shock. I mean, within three days, it spread from one or two of us to everybody in the house," Baca said.

Family members were soon tested by health care professionals for COVID-19. Baca says most people came back positive, like his wife, Renee Baca.

"It wasn't a good feeling. I couldn't breathe. I had a really hard time breathing," Renee said.

While she eventually recovered after a two-week hospital stay, other members of her family did not. Her mother, Sandra Moya, was admitted and passed away.

Before her passing, Baca's son Jason Lee was diagnosed with pneumonia and transferred to UNMH from Presbyterian Hospital.

"Now knowing how bad that my sons got, and my wife got, and that everybody was sick, I just think it’s more serious and that people need to take it a lot more seriously then they have been taking it," Baca said.

Ayden was soon admitted into the pediatric ICU.

"They said that he had a 0% chance of making it. They wanted me to say bye to him, and I said, 'I’m not gonna say bye,'" Renee said.

For six weeks Jason Lee and Ayden have undergone surgeries and utilized ventilators due to heart and breathing complications.

Dr. Walter Dehority, an associate professor for the University of New Mexico's Department of Pediatrics, says parents should get their children vaccinated against COVID-19.

"We are finding more and more cases of severe COVID in children," Dr. Dehority said. "Kids can come in and look like they have a cold, and several days later they could be in the intensive care unit on life support. It can go from zero to 60 in a matter of days."

Baca says his sons are still in the pediatric ICU, but they are getting better.

However, he wishes his family got vaccinated to begin with.

"To see your kids in a bed, with that hose in their throat and not being able to breath on their own, that’s horrible," Baca said.

He now spends his time sharing his story with other families, and praying for a full recovery for his two sons.

"There’s so little that you can do when you’re here," Baca said. "I mean, prayers are one of the main things that you can do. I’ve been praying a lot."

WASHINGTON —

The Biden administration on Thursday put final touches on consumer protections against so-called "surprise" medical bills. The ban on charges that hit insured patients at some of life's most vulnerable moments will take effect Jan. 1.

Patients will no longer have to worry about getting a huge bill following a medical crisis if the closest hospital emergency room happened to have been outside their insurance plan's provider network. They'll also be protected from unexpected charges if an out-of-network clinician takes part in a surgery or procedure conducted at an in-network hospital.

The rules released Thursday detail a key part of the new system: a behind-the-scenes dispute resolution process that hospitals, doctors and insurers will use to haggle over fees. When an insurer and a service provider disagree over fair payment, either side can initiate a 30-day negotiation process. If they still can't come to an agreement, they can take the matter to an independent arbitrator.

There's also a new way for uninsured people and certain patients who pay their own way to get an estimate of charges following an emergency procedure.

"We're hoping to give folks a sigh of relief, who have been blindsided by billing," said Health and Human Services Secretary Xavier Becerra.

Surprise medical bills have been a common problem for people with health insurance, all the more irritating because most patients might have thought they were protected. Charges running from hundreds to tens of thousands of dollars came from doctors and hospitals outside the network of patients' health insurance plans. It's estimated that about 1 in 5 emergency visits and 1 in 6 inpatient admissions triggered a surprise bill.

Although many states already have curbs on surprise billing, federal action was needed to protect patients covered by large employer plans, which are regulated at the national level. A 2020 law signed by then-President Donald Trump laid out a bipartisan strategy for resolving the issue, and the Biden administration filled in critical details.

The idea was to take patients and their families out of the financial equation by limiting what they can be billed for out-of-network services to a fee that's based on in-network charges. That amount gets counted toward their in-network annual deductible.

The new protections are aimed at:

• Protecting patients from surprise bills arising from emergency medical care. Protections apply if the patient is seen at an out-of-network facility, or if they are treated by an out-of-network clinician at an in-network hospital. In either case, the patient can only be billed based on their plan's in-network rate.
• Protecting patients admitted to an in-network hospital for a planned procedure when an out-of-network clinician gets involved and submits a bill.
• Requiring out-of-network service providers to give patients 72-hour notice of their estimated charges. Patients would have to agree to receive out-of-network care for the hospital or doctor to then bill them.

Before the ban on surprise billing, patients usually had to take the initiative themselves to work out unexpected charges. In many cases the hospital or doctor would go back and forth with the insurance company until they reached an agreement. But there was no guarantee that would happen, and patients were at risk of being placed into collection proceedings in situations they had no control over.

SAN JOSE, Calif. — An employee at Kaiser Permanente in San Jose has died after they and dozens of colleagues contracted COVID-19. Officials are investigating the possibility the infections may have come from a Christmas costume.

Kaiser says 44 staff members in the hospital’s emergency department tested positive for COVID-19 between December 27 and January 1. The facility was investigating the outbreak and told KGO the spread “may” have been connected to an “air-powered costume.”

The blow-up holiday costume, reportedly a giant Christmas tree, was worn by a staffer who “briefly” visited the emergency department on December 25, according to KNTV.

Inflatable costumes usually rely on battery-operated fans to suck air into the costume to keep its shape. COVID-19 spreads through droplets in the air, which is why investigators are looking into the air circulation function of the fan.

Kaiser says the costume was not approved beforehand by the hospital.

The person who died has been identified by San Francisco media as a registration clerk in the emergency department of the hospital.

NEW YORK — Tanya Roberts, who captivated James Bond in “A View to a Kill” and appeared in the sitcom “That ’70s Show,” died Monday, several hours after she was mistakenly declared dead by her publicist and her partner.

Roberts' partner Lance O'Brien confirmed her death Tuesday after picking up her personal effects at a Los Angeles hospital. Her publicist shared the news with media outlets, who prematurely published Roberts obituary.

Roberts reportedly collapsed on December 24 after walking her dogs and was put on a ventilator at the hospital, according to the New York Times. The publicist did not give a cause of death, only that it was not related to COVID-19.

One of Roberts' highest-profile roles was playing geologist Stacey Sutton opposite Roger Moore in 1985′s “A View to a Kill.” Roberts appeared in the final season of “Charlie’s Angels” and later played Midge Pinciotti in the sitcom “That ’70s Show.”

Her fellow "angel" during that final season, Jaclyn Smith, shared a photo of the three of them Tuesday after news of Roberts' passing.

"She brought joy to so many people and had a career spanning decades. Good bye angel, Rest In Peace," Smith shared on Instagram.
