					Elizabeth Holmes, the former CEO of Theranos who was convicted earlier this month on four out of 11 federal fraud and conspiracy charges, will not be sentenced until Sept. 26, according to a new filing.The prosecution and defense had proposed Sept. 12 for a sentencing hearing in a court filing Tuesday, stating in the filing that "following Labor Day 2022 would be appropriate in light of ongoing proceedings in a related matter," a reference to the upcoming trial of Holmes' second-in-command at Theranos who faces the same charges as her. In a court order signed Wednesday, Judge Edward Davila, who is presiding over Holmes' case, set her sentencing hearing for later in September. By that point, it will have been more than a full year since her trial kicked off.Until then, Holmes remains free on a $500,000 bond secured by property, according to the earlier filing from the prosecution and defense.According to the indictment, Holmes faces up to 20 years in prison as well as a fine of $250,000 plus restitution for each count. Judge Davila will ultimately decide Holmes' sentencing as he sees fit, using sentencing guidelines as a reference.Holmes, 37, was first indicted more than three years ago alongside Ramesh "Sunny" Balwani, the former COO and president of her failed blood testing startup who was also her ex-boyfriend. Their trials were severed after Holmes indicated in court filings that she intended to point the finger at Balwani, accusing him of psychological and sexual abuse. Holmes testified to this when she took the stand in her own defense. Once regarded as the next Steve Jobs, Holmes raised $945 million from investors, catapulting her startup to a $9 billion valuation and making her a paper billionaire in the process. But her technology didn't work as she claimed, and it all came crashing down.After 50 hours of jury deliberations spread out over the course of seven days, Holmes was found guilty of four charges, including one count of conspiracy to defraud investors and three wire fraud counts tied to specific investors. The jury acquitted Holmes of three counts of defrauding patients and one count of conspiracy to defraud patients.There were three additional wire fraud counts tied to other investors that jurors could not reach a unanimous agreement on and for which Judge Davila declared a mistrial. 					The Wisconsin pharmacist who pulled dozens of COVID-19 vaccine vials from a hospital refrigerator, agreed to plead guilty in federal court of attempting to tamper with the vaccine, a review by sister station WISN 12 News of the plea agreement determined.The agreement, which was filed in the U.S. District Court for the Eastern District of Wisconsin, allowed Steven Brandenburg, of Grafton, to avoid an indictment by a federal grand jury and plea to two counts of  attempting to tamper with consumer products, with reckless disregard for the risk that another person will be placed in danger of death or bodily injury, the records show.According to the deal, Brandenburg, 46,  admitted to pulling the same box of Moderna COVID-19 vaccine out of the refrigerator at Aurora Medical Center - Grafton on consecutive days late last month. The Moderna vaccine needs to be stored at specific temperatures to remain effective. "Recklessly disregarding his knowledge of the applicable storage specifications and the associated risks, Brandenburg, on two successive shifts that began on the evenings of December 24 and December 25, 2020, removed the same box of Moderna COVID-19 Vaccine from the refrigerator in the pharmacy at the Grafton Facility, for periods of multiple hours, intending to render that same vaccine inert or ineffective," the plea document noted.During the investigation, it was determined 57 people had received doses of the vaccine from the vials in the box Brandenburg handled.According to the plea agreement, he believed in various "conspiracy theories," subscribed to notions of "alternative history" and was skeptical of vaccines in general and the Moderna vaccine specifically."Distributing the COVID-19 vaccine is critical to overcoming this pandemic, which continues to end lives and upend our economy," United States Attorney Matthew Krueger said in a news release. "As these charges show, the Justice Department will pursue anyone — and especially any medical professional — who tampers with the vaccine."When asked about the plea deal, Brandenburg's attorney told WISN 12 News, "No comment." <p>SALT LAKE CITY, Utah — Jennifer Shah, a cast member on "The Real Housewives of Salt Lake City," and her assistant, Stuart Smith, <a class="Link" href="https://www.fox13now.com/news/local-news/real-housewives-of-salt-lake-city-star-jen-shah-arrested-on-suspicion-of-fraud">were arrested Tuesday morning</a> on suspicion of running a nationwide telemarketing fraud and money laundering scheme.</p>
<p>“Jennifer Shah, who portrays herself as a wealthy and successful businessperson on ‘reality’ television, and Stuart Smith, who is portrayed as Shah’s ‘first assistant,’ allegedly generated and sold ‘lead lists’ of innocent individuals for other members of their scheme to repeatedly scam. In actual reality and as alleged, the so-called business opportunities pushed on the victims by Shah, Smith, and their co-conspirators were just fraudulent schemes, motivated by greed, to steal victims’ money. Now, these defendants face time in prison for their alleged crimes," said Manhatten U.S. Attorney Audrey Strauss.</p>
<p>Shah and Smith allegedly defrauded victims by selling "business services" after enticing them to enter business opportunities on sales floors in Utah, Nevada, and Arizona. They would then allegedly sell the names of the people who bought into these opportunities to telemarketers in New York and New Jersey.</p>
<p>Telemarketers would then sell alleged services purporting to make the victims’ businesses more efficient or profitable, including tax preparation or website design services, even though many victims were elderly and did not own a computer.</p>
<p>Shah and Smith, who allegedly ran the operation since 2012, controlled which telemarketers received "leads" to whom they could offer fraudulent services. Hundreds of victims, many over age 55, were targeted.</p>
<p>HSI Special Agent-in-Charge Peter C. Fitzhugh said: “Shah and Smith flaunted their lavish lifestyle to the public as a symbol of their ‘success.’ In reality, they allegedly built their opulent lifestyle at the expense of vulnerable, often elderly, working-class people . . .  As alleged, disturbingly, Shah and Smith objectified their very real human victims as ‘leads’ to be bought and sold, offering their personal information for sale to other members of their fraud ring.  As a result, their new reality may very well turn out differently than they expected.”</p>

<p>CINCINNATI — A political consultant and longtime campaign aide to Rep. Steve Chabot faces federal wire fraud and falsification of records charges as prosecutors say he embezzled more than $1.4 million from Chabot's Congressional campaign.</p>
<p>A Tuesday filing against 41-year-old James R. Schwartz II, of Cincinnati, detailed a years-long attempt to embezzle from “Congressional Campaign A."</p>
<p>According to court documents, Schwartz worked as a consultant for the campaign through his companies Fountain Square Group, LLC and Prime Media, LLC, from approximately 2011-2019. Fountain Square Group closed in 2019 during the investigation.</p>
<p><b>FROM 2019: Closure of political firm as feds investigate missing money to have 'no impact' on local GOP races</b></p>
<p>Schwartz served as the “de facto treasurer” for the campaign, according to the U.S. Attorney for the Southern District of Ohio. Court documents said Schwartz wrote multiple checks to himself and his companies from the campaign that were for more money than he and his companies actually earned. In 2019, the FEC sent a letter to Schwartz, asking why an amended campaign finance report showed a $123,625 increase in receipts that had not been disclosed on the original report.</p>
<p>Schwartz allegedly concealed the funds by misrepresenting the amounts paid to him and his companies in reports to the FEC through fabricated bank statements and other documents.</p>
<p>Wire fraud and falsifying records in a federal investigation are crimes punishable by up to 20 years in prison, the U.S. Attorney’s office said.</p>
<p>"Congressman Chabot and his campaign thank the prosecutors and members of law enforcement who worked on this case for their dedication to delivering justice,” said Chabot for Congress attorney Megan Sowards Newton in a statement Tuesday. “The campaign was deeply disappointed to learn the scale of Mr. Schwartz’s crimes and is grateful to all the officials involved for bringing this matter to its appropriate resolution.”</p>
<p>A plea document was also filed in federal court Tuesday, which will be considered at a future hearing.</p>
<p>"Jamie voluntarily turned himself into federal authorities some time ago, and he has fully cooperated with the investigation. He accepts responsibility for his actions and is extremely remorseful," said Schwartz's attorney, Kevin Tierney.</p>

<p>CINCINNATI — Two anti-corruption proposals passed handily Tuesday on Cincinnati's primary ballot, each scoring approval by a margin of more than three-to-one.</p>
<p>Brought before voters after a string of corruption scandals at City Hall, both ballot measures -- Issues 1 and 2 -- were procedural and sought to change the ways City Council can deal with a member who has come under indictment, along with installing other ethics requirements of its members.</p>
<p><b>IN-DEPTH:</b> What exactly are Issue 1 and Issue 2 about?</p>
<p>With all precincts reporting, the unofficial count showed 76.8% of voters approved Issue 1, while 23.3% opposed it. The measure will mean, once indicted, a member can no longer change their pre-designated replacement, should they be suspended. It also allows the city's attorney to appoint a special prosecutor to investigate the case on the city's behalf.</p>
<p>Issue 2 took a slightly wider margin at the polls, with 77.4% for and 22.6% against. It also takes a slightly sharper tack by allowing members of City Council to suspend a member brought under indictment, which currently requires a lengthy court process.</p>
<p>The measure also requires council members to undergo ethics training and reiterates Issue 1's provision that a member under indictment cannot change their successor if they are suspended.</p>
<p>Between February 2020 and last month, four sitting members of City Council came under indictment in either county or federal court. Federal agents arrested former member Tamaya Dennard and now-suspended members Jeff Pastor and P.G. Sittenfeld over the course of last year, accusing them of soliciting or taking bribes in exchange for votes or favor on development deals.</p>
<p>A grand jury indicted Councilman Wendell Young last month on felony charges, accusing him of tampering with evidence related to the "Gang of Five" texting scandal of 2018.</p>
