MASS SHOOTINGS HIT OUR HIT AREAS RANGING FROM PHILADELPHIA TO TEXAS. AND IN THE NATION’S CAPITAL, NINE PEOPLE WERE SHOT AT A HOLIDAY GATHERING IN D.C. THEY ARE ALL EXPECTED TO SURVIVE FREE JACKSON IN WASHINGTON WITH THE PRESIDENT’S REACTION TO THIS LATEST STRING OF GUN VIOLENCE, PRESIDENT BIDEN IS ONCE AGAIN URGING CONGRESS TO STRENGTHEN GUN LAWS AFTER A SPATE OF MASS SHOOTINGS OVER THE EXTENDED JULY 4TH HOLIDAY. A VIOLENT AND DEADLY JULY 4TH WEEKEND ACROSS AMERICA. EVERYBODY OUT THERE FIRED BACK. FIVE PEOPLE WERE KILLED AND TWO CHILDREN INJURED IN PHILADELPHIA MONDAY NIGHT. POLICE ARE USING THIS SURVEILLANCE VIDEO AS PART OF THEIR INVESTIGATION. AUTHORITIES SAY THE 40 YEAR OLD SUSPECT WEARING BODY ARMOR WALKED ON THE STREET WITH AN AR 15 STYLE RIFLE AND A HANDGUN, FIRING RANDOMLY. IT JUST MAYHEM. YOU CAN’T EXPLAIN IT THE WAY IT WAS APPLIED ALL OVER THE PLACE. I HEARD A YOUNG MAN SCREAMING LIKE, HELP OUT. WELL, PLEASE HELP THESE PEOPLE WALKING BY. IT’S A DISGRACEFUL, BUT ALL TOO COMMON SITUATION IN AMERICA IN A SEPARATE, DEADLY SHOOTING. POLICE IN FORT WORTH, TEXAS, SAY THREE PEOPLE WERE KILLED, EIGHT OTHERS INJURED DURING A 4TH OF JULY CELEBRATION. THAT SENSELESS MAN, YOU KNOW, YOU HAD PEOPLE COME IN TO A FAMILY ENVIRONMENT WITH GUNS AND START SHOOTING RANDOMLY DELIVERING REMARKS TO THE NATIONAL EDUCATION ASSOCIATION. SOME PEOPLE GETTING BACK INTO THE SWING OF THINGS, OTHERS JUST TAKING THE WEEK TO COAST. WE DON’T BLAME YOU. YOU MIGHT WANT TO SPEND SOME OF THAT TIME AT A POOL BECAUSE IT’S GOING TO BE HOT. YEAH, HOT. AND HUMID. SO IT FEELS EVEN WARMER OUT THERE, WHICH IS EVEN WORSE FOR OUR REGION. AND THAT’S ALSO WHEN YOU’RE GOING TO MAKE SURE TO STAY HYDRATED BECAUSE THAT HUMIDITY CAN REALLY PULL A LOT OF THE YOU CAN REALLY BRING DOWN YOUR ENERGY AND BRING UP SOME HEALTH RISKS OUT THERE AS WE LOOK OUTSIDE. YOU ALSO WILL NOTICE SOME HAZINESS AND THAT’S NOT THIS TIME FOR A WILDFIRE SMOKE THAT IS, IN FACT, FROM THAT HUMIDITY THAT MANY OF US ARE DEALING WITH. TEMPERATURES ALREADY HERE AT NOONTIME AT 87 IN CINCINNATI, DELL HIGH, 88 IN HAMILTON AND IN OXFORD, 83 OUT THERE IN BATESVILLE AND 84 AND DRIVER, KENTUCKY. BUT AS WE LOOK AT THE DEW POINTS, WE DON’T TALK ABOUT THEM A LOT, BUT USUALLY BRINGS UP WHENEVER WE HAVE THIS HUMIDITY AROUND AND WE ARE IN THE UPPER SIXTIES AND LOWER SEVENTIES WITH DEW POINTS ANY TIME WE’RE REALLY INTO THE UPPER SIXTIES, EVEN WITH DEW POINTS THAT MEANS IT’S A VERY MUGGY FEEL. AND SO HEAT INDEX VALUES FEELING LIKE WE’RE INTO THE LOWER NINETIES, 91 IN CINCINNATI, HAMILTON 90, HARRISON 92. THE FEELS LIKE IN FLORENCE AND WE STILL HAVE MORE TO CLIMB OUT THERE FOR TODAY AS WE MAKE OUR WAY NEAR 90 DEGREES FOR ACTUAL TEMPERATURES THOUGH I HAD MY FORECAST. WE’RE TALKING MORE ABOUT THAT HEAT HUMIDITY TODAY AND WHEN MORE STORM CHANCES COULD B

A Manhattan grand jury has voted to indict Daniel Penny, the Marine veteran who held Jordan Neely in a fatal chokehold on the New York City subway, according to a source with knowledge of the case. Penny, 24, was indicted on second-degree manslaughter charges. Penny surrendered to police last month to face a second-degree manslaughter charge. He has since been out on a $100,000 bond. Penny held Neely, a homeless man and street artist, in a chokehold on the subway train on May 1 after Neely began shouting at passengers that he was hungry and thirsty and didn’t care whether he died. Penny forced 30-year-old Neely to the train floor and restrained him in a chokehold until he stopped breathing. A medical examiner ruled Neely’s death a homicide. Video above: Rev. Al Sharpton delivers Jordan Neely's eulogyCNN has reached out to Penny’s attorneys and the attorneys representing Neely’s family. In May, Penny told the New York Post he was “deeply saddened by the loss of life,” amid what has become a contentious homicide case that has highlighted the city’s handling of unhoused people.Neely was on a New York City Department of Homeless Services list of the city’s homeless with acute needs – sometimes referred to internally as the “Top 50” list – because people on the list tend to disappear, a source told CNN.Penny told the newspaper he would take action in a similar situation again, “if there was a threat and danger in the present.” Penny said he is not a white supremacist and race was not a factor. In response to the May interview, Neely family attorneys called Penny a “killer.”“This is an advertisement to soften the public’s view of Daniel Penny who choked Jordan Neely to death. We never called him a white supremacist, we called him a killer,” attorneys Donte Mills and Lennon Edwards said at the time. “We want to know why he didn’t let go of that chokehold until Jordan was dead.”Neely’s killing, part of which was captured on video that was posted online, sparked demonstrations calling for justice in his case as Manhattan prosecutors spent days deliberating how to proceed before apprehending and charging Penny.

A farmworker accused of killing seven people in back-to-back shootings at two Northern California mushroom farms will be charged with seven counts of murder and one of attempted murder, a prosecutor said Wednesday. The charges will be filed before Chunli Zhao, 66, makes his first court appearance Wednesday afternoon, said Steve Wagstaffe, the district attorney for San Mateo County. It was not immediately clear whether Zhao had an attorney who could speak on his behalf.Authorities believe Zhao acted alone Monday when he entered a mushroom farm where he worked in Half Moon Bay and opened fire, killing four people and seriously wounding a fifth, San Mateo County sheriff’s officials said. He then drove to another nearby farm where he had previously worked and killed an additional three people, said Eamonn Allen, a sheriff’s spokesperson. The sheriff's office said it believes the shootings were “workplace violence" but has not further detailed a motive. It was California's third mass shooting in eight days, including the killing of 11 in Monterey Park in the Los Angeles area amid Lunar New Year celebrations Saturday.Zhao also faces a special circumstance allegation of multiple murder, as well as sentencing enhancements on each count for the use of a firearm, Wagstaffe said.If convicted of the special circumstance, Zhao could face life in prison without the possibility of parole or the death penalty. Gov. Gavin Newsom issued a moratorium on executions in 2019.Officials have not yet released the names of the five men and two women who died, nor the one man who was injured. Some were Asian and others were Hispanic, and some were migrant workers.Servando Martinez Jimenez said his brother Marciano Martinez Jimenez, who was a delivery person and manager at one of the farms, was among those killed. Servando Martinez Jimenez said his brother never mentioned Zhao or said anything about problems with other workers.“He was a good person. He was polite and friendly with everyone. He never had any problems with anyone. I don’t understand why all this happened,” Martinez Jimenez said in Spanish.Marciano Martinez Jimenez, 50, had lived in the United States for 28 years after arriving from the Mexican state of Oaxaca. Servando Martinez Jimenez said he is working with the Mexican consulate to get his brother’s body home.Allen declined to answer questions about whether Zhao had any previous criminal history, saying, “there were no specific indicators that would have led us to believe he was capable of something like this.”But it would not have been Zhao’s first fit of workplace rage, the San Francisco Chronicle reported. In 2013 Zhao was accused of threatening to split a coworker’s head open with a knife and separately tried to suffocate the man with a pillow, the Chronicle reported, based on court documents. The two were roommates and worked at a restaurant, and the man, identified as Jingjiu Wang, filed a temporary restraining order against Zhao that was granted but is no longer in effect. Wang could not be immediately reached, the Chronicle reported.Video below: California Gov. Three have occurred in California since Jan. 16, according to a database compiled by The Associated Press, USA Today and Northeastern University. The database tracks every mass killing — defined as four dead, not including the offender — in the U.S. since 2006.The shootings in Half Moon Bay and Monterey Park followed the killing of a teenage mother, her baby and six others at a home in California’s Central Valley on Jan. 16. Officials discussing the investigation mentioned a possible gang link to the killings.

<p>A farmworker accused of killing seven people in back-to-back shootings at two Northern California mushroom farms will be charged with seven counts of murder and one of attempted murder, a prosecutor said Wednesday.</p>
<p>The charges will be filed before Chunli Zhao, 66, makes his first court appearance Wednesday afternoon, said Steve Wagstaffe, the district attorney for San Mateo County.</p>

<p>It was not immediately clear whether Zhao had an attorney who could speak on his behalf.</p>
<p>Authorities believe Zhao acted alone Monday when he entered a mushroom farm where he worked in Half Moon Bay and opened fire, killing four people and seriously wounding a fifth, San Mateo County sheriff’s officials said. He then drove to another nearby farm where he had previously worked and killed an additional three people, said Eamonn Allen, a sheriff’s spokesperson.</p>
<p>The sheriff's office said it believes the shootings were “workplace violence" but has not further detailed a motive. File video above: Legal analysis on charges filed against Alec Baldwin on 'Rust' movie set shootingProsecutors in the "Rust" fatal shooting case plan to file a notice to dismiss involuntary manslaughter charges against Alec Baldwin, his attorney, Luke Nikas, tells CNN.CNN has contacted the special prosecutor in the Santa Fe, New Mexico case for comment.Halyna Hutchins, the film's cinematographer, was struck and killed by a live round of ammunition fired from a prop gun being held by Baldwin while rehearsing a scene on the set of "Rust" in 2021. Baldwin has pleaded not guilty.Director Joel Souza was also shot and injured.Baldwin and "Rust" armorer Hannah Gutierrez Reed were both charged with involuntary manslaughter in January. Baldwin pleaded not guilty. An attorney for Gutierrez Reed has previously said she will plead not guilty and has maintained her innocence. A preliminary hearing in her case is set for May 3.Prosecutors already removed a firearm enhancement charge against Baldwin and Gutierrez Reed, reducing a potential prison sentence from 5 years to a maximum of 18 months."We are pleased with the decision to dismiss the case against Alec Baldwin and encourage a proper investigation into the facts and circumstances of this tragic accident," Baldwin's attorneys Luke Nikas and Alex Spiro told CNN.Thursday's development comes one month after the special prosecutor in the case, Andrea Reeb, stepped down, following a motion by Baldwin's attorney to have Reeb disqualified as "unconstitutional" under New Mexico law due to her elected position in the New Mexico House of Representatives. Santa Fe District Attorney Mary Carmack-Altwies then also stepped away from the case and appointed long-time New Mexico attorneys Kari Morrissey and Jason Lewis to serve as special prosecutors.Earlier this year, "Rust" assistant director Dave Halls and prosecutors reached a plea agreement "for the charge of negligent use of a deadly weapon." At the time, prosecutors said the terms of that deal include six months of probation and a suspended sentence. As part of a wrongful death settlement between Matthew Hutchins, the widower of Halyna Hutchins, Baldwin and "Rust" producers, production on the film has resumed. Matthew Hutchins is now serving as an executive producer on the project.

Discussions of workplace safety are now front and center after the fatal 'Rust' movie set shooting at Bonanza Creek Ranch. On Oct. 21, Santa Fe County deputies said Alec Baldwin, the actor and co-producer of the film, discharged a prop gun that misfired. The weapon fatally wounded cinematographer Halyna Hutchins and injured director Joel Souza. Questions also remain, like how live rounds showed up on the set. The lawyer for the film's armorer, 24-year-old Hannah Gutierrez, released a statement Friday. Jason Bowles said Gutierrez had no idea where the live rounds came from and added that the guns were locked up every night. The incident has been a big concern for many people, including Baldwin. On Saturday, Baldwin briefly spoke with reporters in Vermont, where he and his family have been laying low since the shooting."An ongoing effort to limit the use of firearms on film sets is something I’m extremely interested in," Baldwin said. The actor added safety measures are needed when it comes to guns on movie sets."We have to realize that when it does go wrong, and it’s this horrible, catastrophic thing, some new measures have to take place," Baldwin said. "Whatever other people decide is the best way to go in terms of protecting people’s safety on film sets."New Mexico Gov. Michelle Lujan Grisham said the state may take action to address those concerns. Her office provided the following statement to sister station KOAT: "Workplace safety in any and every industry in New Mexico is absolutely paramount. A workplace death is never acceptable and must compel an analysis of what can and should be done better. My full expectation is that the film and television industry will, at the conclusion of the investigation into this tragic incident and once all the facts are in hand, bring forward comprehensive new safety protocols to ensure this kind of incident never, ever happens again. If that sort of comprehensive new approach does not materialize, the state of New Mexico will take immediate action, throughout whatever means are available to us, to ensure the safety of all personnel on all film and television sets here in our state. This industry is important to us economically and to so many workers throughout New Mexico, and I look forward to a full accounting of how this could have possibly happened, and we will determine our next steps from there."The investigation is still ongoing and no charges have been filed. Production on the movie 'Rust' has since halted.

<p>SOUTHGATE, Ky. — More than 40 years after a fire tore through the Beverly Hills Supper Club, killing 165 people, the public will be able to discuss plans for a new development on the site of the fire Tuesday night.</p>
<p>In May, plans were announced to build a $65 million residential development on the site of the former restaurant. The 80-acre development, called Memorial Point, would include luxury apartments, single-family homes and an assisted-living center as well as a memorial to 165 people killed in the fire, officials said in a release.</p>
<p>The city of Southgate approved Ashley Builders and Vision Realty Group for the construction of the development.</p>
<p>"We're very excited about it," Southgate Mayor Jim Hamberg said. "I've been on this for 15 years, to get it this far, and it's very very satisfying, almost satisfying, to know we're almost there."</p>
<p>And while the development might look good to people from the outside, one survivor of the fire isn't convinced it's a good idea.</p>
<p>David Brock was there the night the Beverly Hills Supper Club caught fire and he said he will never forget that night.</p>
<p>"We couldn't get the door shut," Brock said. "By the time I was outside, the whole building was up in flames."</p>
<p>Brock said the developers of the site reached out to him in March for his opinion on the construction.</p>
<p>"I told them I didn't think they should build on top of where the people had perished," Brock said.</p>
<p>After speaking with Brock, the developers made some changes to their plan so they wouldn't be building on a particular portion of the site.</p>
<p>The Campbell County and Municipal Planning and Zoning Commission are holding a hearing at 6 p.m. Tuesday night to listen to other concerns people might have about the construction. The public can watch the hearing live on Facebook <a class="Link" href="https://www.facebook.com/cityofsouthgateky/">here</a>.</p>
